Charges framed against 13 accused including Tallo, Nago, Ajab

JAMMU, May 8: In a much publicized murder of Chopra Family members and their employee, finally after six years Court framed charges against 13 accused namely Mahesh, Russi, Vicky, Nanju, Bhawani Singh, Sikander, Narinder, Sangram Singh, Dalip, Ajab Singh, Tarlochan Singh, Nagar Singh and Rajinder Singh.
Court also initiated process u/s 512 CrPC against accused Kiran Pradhi and Sanjay Kumar. Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal today framed charges U/Ss 302/396/201 RPC against the accused Mahesh, Russi, Vicky, Nanju, Bhawani Singh, Sikander, Narinder and Sangram Singh. Court also framed charges u/s 302/396/120-B/109 RPC against the accused Dalip whereas Court framed charges u/ss 302/120-B RPC against the accused Ajab Singh, Tarlochan Singh Wazir Ex-MLC (NC), Nagar Singh and Rajinder Singh and fixed four days calendar for recording the evidence. Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing battery of lawyers observed that the roving inquiry is required to be made by the court while implanting charge on the accused and the case has not be tested on the touchstone of trial and ultimately the consequent result of the same unless the prosecution comes forward with the explanation on each and every aspect of the case. The statements of various prosecution witnesses i.e. Surinder Singh @ Kala, Harminder Paul Singh, Rajinder Singh @ Raju, Rohit Chopra and Dinesh Kumar u/s 161 CrPC and 164 CrPC are on record which prima facie establishes that the accused Ajab Singh, Tarlochan Singh, Nagar Singh and Rajinder Singh hatched the criminal conspiracy and executed the same. So far as the evidence against other accused is concerned, there is sufficient evidence to proceed against them.
Court further said that there is material evidence that meeting was attended by Surinder Singh @ Kala, Tarlochan Singh, Ajab Singh, Nagar Singh and Rajinder Singh and disclosed the aforesaid meeting and transpired thereon for the first time. So far as the delay in surfacing of witnesses is concerned, is a matter for the trial and an opportunity have to be granted to the prosecution to explain the delay appearing therein. Court agreed with the learned Special PP L.K. Sharma that unless the prosecution is given an opportunity to explain its omissions or any doubtful situation and the mouth of the prosecution can not be dub at this stage and without affording an opportunity to the prosecution, the real facts are not likely to come surface.
Jamwal further observed that without commenting upon the merits of the case, that the evidence which has been procured by the prosecution has to be appreciated for limited purposes at the time of charge and discharge. The arguments raised by the counsels for accused, at this stage, are not tenable and I am satisfied that there is sufficient material on record to implant charge on the accused. Accordingly, prima-facie, offences U/Ss 302/396/201 RPC are made out against the accused Mahesh, Russi, Vicky, Nanju, Bhawani Singh, Sikander, Narinder and Sangram Singh and they are charged for the same offences. Prima-facie offences U/Ss 302/396/120-B/109 RPC are made against the accused Dalip and he is charged for the same offences. Prima-facie, offences U/Ss 302/120-B RPC are made out against the accused Ajab Singh, Tarlochan Singh, Nagar Singh and Rajinder Singh and they are charged for the same offences.
