| Pension amount embezzlement worth Rs 7.66 Lakh | | Accused denied bail | | Early Times Report
Jammu, May 10: Special Municipal Magistrate Jammu VS Bhou today rejected the bail application of one Shiv Sagar Son of Ram Jai Yadav R/o Satwari who was booked in FIR NO 88/2012 by P/S Satwari u/s 468/467/471/420 RPC for embezzlement of pension amount to the tune of Rs 7.66 lakh of different pensioners.While rejecting the bail application Special Municipal Magistrate Jammu VS Bhou after hearing Senior PO Rohit Gupta for the state and Sr. Adv Surinder Kour for the accused observed that CD file categorically indicates that investigation is at initial stage and more cases of embezzlement of amount of pensioners are being unearthed and possibility of higher-ups in the entire incident cannot be ruled out and it is specific from the CD that IO has taken steps for procuring the attendance of co-accused presumed to be involved in the alleged offences and thus custodial interrogation of the accused in presence of other suspects is imperative. Merely that accused has deposited the amount diverted in false account cannot be a ground for absolving the accused of the allegations which pin-points the involvement of accused in the said case. Court further said enlargement of accused at this stage would scuttle the investigation and accused may temper with evidence and otherwise also bail at this stage would not be in public interest which is also of paramount consideration. With these observations Court rejected the bail application.(JNF) |
