9 year RI to alleged militant | | | early times report Jammu, May 12: Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal today awarded Nine Years Rigorous Imprisonment to convict/accused Mustaq Ahmed code Mohd Iqbal son of Nizam-Din r/o Haveli Poonch u/s 7/25 Arms Act. According to the police case that on January 1, 2003 on receipt of specific information regarding presence of militants in the village Checheian Bandi. The Unit laid carden of the village and in the operation one militant namely Mustaq Ahmed apprehended by the unit along with rifle AK, ammunition 120 Cartridges , 4 AK Magazine, 2 Grenade 2, Radio Set-1. The apprehended militant along with recovered articles hand-over to the police station concerned for registration of case, the police registered FIR NO 1/2003 for offence u/s EAO and 7/25/26/27 Arms Act against the accused and after completion of investigation challan was presented. Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing Public Prosecutor Shabir Choudhary for the state and Adv Prince Khanna for the accused observed that the offence committed by the accused does not invite any lenient view, but seen the age of the convict accused, law and legal provisions contained in arms act, the minimum sentence is provided for seven years and fine and maximum is for 10 years. Court is of the conscious of the fact that accused has been aiding and was providing the arms and ammunition to the militants but no such evidence could be collected. But it was only collected that accused were in possession of Arms and ammunition only. Court further said that the country is under going such a face that entire country is under the threat militancy. These kind of people are mis-guided youth has to be discouraged from such kind of activities and Court is satisfied that sentence of nine years shall serve the purpose and awarded Nine years rigorous imprisonment to Mustaq Ahmed code Mohd Iqbal. |
