State High Court orders LAWDA to take over controversial Srinagar farmhouse

SRINAGAR, May 15: The Jammu and Kashmir High Court today ordered the Lakes and Waterways Development Authority (LAWDA) to take over the controversial farmhouse that had come up outside the Dachigam National Park in summer capital Srinagar.The State High Court had earlier directed the State Government to produce any construction permission if it had been given to the farmhouse owners.
State Advocate General, Mohammad Ishaq Qadri today produced a report in the court in which it was mentioned that no permission had been given by concerned authorities for the construction of the farmhouse.
Acting Chief Justice, Justice Virender Singh after seeing the report ordered that the construction of the farmhouse should be stopped immediately and directed LAWDA to take custody of the farmhouse along with two other structures inside it. The lawyer of the respondents claimed that these constructions did not fall under the green belt and the respondents themselves had mentioned in the copy that the structures were built before 1999 when the LAWDA was not set up.
Vice chairman LAWDA, Irfan Yasin also admitted that no permission regarding the construction had been given and showed the court downloaded Google images of the area. In the images it was clear that all the buildings had come up in the last few years.
Justice Virender Singh while commenting on the silence of LAWDA over these years remarked, "The LAWDA was wearing goggles instead of spectacles over these years."
Sources in the LAWDA said the authority would be taking over the possession of the farmhouse as soon as it would get a copy of the Court order.
It must be mentioned that former Director of State Information Department Haji Farooq Renzu Shah had denied media reports that the farmhouse belonged to him. Renzu Shah has, however, admitted that the farmhouse belonged to his in-laws, as per media reports.
Tuesday's High Court direction assumes significance in light of the fact that a similar direction could now follow many other structures in the area those have been constructed close to the Dachigam National Park in Srinagar.
