RS 9 lakh fraud with innocent claimant | Bail denied to Patwari, associate | | early times report Jammu, May 16: The patwari and his accomplice have been denied bail in cheating to the tune of Rs. 9 lakh to an innocent claimant of compensation. Principal Sessions Judge Udhampur B M Gupta rejected the bail application of Uttam Singh Patwari and his associate Ramesh Singh accused in the fraud. According to the police case on April 25, 2012 one Kashmir Singh resident of Roun Domail lodged a complaint stating therein that last year CRPF acquired 408 kanal 6 marlas of land in village Roun and his land was also acquired. The Revenue Department in the month of December 2011 received first installment of compensation with regard to his land. Applicant Uttam Singh (Patwari) called him and enquired about his bank account and he told that he has no bank account. On this Patwari obtained his signatures on some forms stamped with ticket and gave to Romesh Singh and told that these forms are required to open the bank account. Thereafter Patwari left and Romesh Singh took him to J&K Bank Branch Main and told that payment of Rs. 2, 73,000/- (rupees two lakh seventy three thousand) has been received in his name and they have provided him special benefit and he should immediately withdraw the amount and after withdrawal the amount destroy or torn the passbook otherwise he could face difficulty in getting the second installment. He later on enquired from the bank and was told that he got compensation of Rs. 11,73,000/- (rupees eleven lakh seventy three thousand) and out of the said amount an amount of Rs. 9,00,000/- (rupees nine lakh) was transferred to the account of Romesh Singh through transfer vouchers in league and connivance by both the applicants/accused as well as other officials of Revenue Department and they have cheated him by taking Rs. 9,00,000/- (rupees nine lakh) by getting his signatures on some blank forms with fraudulent and malafide intention by transferring the amount of Rs. 9,00,000/- (rupees nine lakh) from his account to the account of Romesh Singh. The complainant further told that he enquired from accused persons who told that so many officers are involved and threatened him of dire consequences. Principal Sessions Judge Udhampur B M Gupta after hearing the arguments of counsels for the parties and also the police observed that accused Uttam Singh has misused his official position as he himself called all the intending claimants in the bank and then got opened their bank accounts by putting his own introduction in the bank opening forms and then induced the claimants to sign blank transfer vouchers on the pretext of providing special benefit as well as early release of second installment . The accused persons intentionally and with malafide purpose made a mischievous plan to earn wrongful gains for themselves and for others and have swindled the compensation amount and deceived the poor and innocent claimants. Moreover in this case larger interest of the public is involved as number of persons have been cheated and the police is making efforts to trace the persons who have been benefited through the large amount swindled by the accused persons . The poor public and innocent illiterate villagers were deprived of their due compensation and many other persons/ complainants are approaching the police with similar complaints. With these observations Court rejected bail applications. |
