State losing Central funds worth hundreds of crores

Jammu, May 18 : Harsh Dev Singh has lambasted the State Govt. for its persistent policy of delay and deny in the matter of holding of Urban Local Bodies (ULB) elections in the State. He said that the elections to Urban Local Bodies which were due in early 2010 have been inordinately and inexplicably delayed by more than two years with the govt. coming out with lame excuses on several occasions. He said that non holding of elections has deprived the state of central funding worth hundreds of crores which has been declined by the Union Govt. on account of failure of state govt. to constitute the said Municipal bodies.
Harsh Dev said that the state govt. has not only been apathetic and negligent in ensuring time bound elections to the said bodies but has committed violations of legal provisions of Municipal Act and Municipal Corporation Acts in the process. He said that first meetings of all municipal bodies having been held in March-April 2005, the elections ought to be have been completed prior to March 2010 which has not been done by the govt. thus creating a legal infirmity in exercise of its powers under the said laws.
Singh further made a reference to municipal corporation act which envisages in Sec 5 that elections to constitute Municipal Corporations shall also be held before the expiry of its term of five years thus categorically providing that election process ought to have been completed in early 2010. He said that non constitution of representative Urban Bodies in the State had further enabled the govt. to rule and administer the urban areas by proxy. He regretted that in the process, the state govt. had totally disregarded the deprivation of urban population caused due to blockage of huge central funding. Expressing serious concern, Harsh Dev appealed to the state governor to intervene so as to check further violations of legal provisions and to further ensure that the people were not deprived of their genuine democratic right and aspirations.
