Held for abetting wife to commit suicide, man granted bail

JAMMU, May 21: Third additional sessions judge Sanjay Parihar today granted bail to a man who was charged with abetting his wife to commit suicide on the condition that he would not at any stage try to influence witnesses in the case.
Romesh Kumar, son of Beli Ram of Mazdoor Basti, Bakshi Nagar, was arrested by police after his wife had committed suicide allegedly by setting herself ablaze on September 20, 2011. He was booked under section 306 of RPC.
In his petition, Romesh submitted that police had falsely implicated him in the case as he never ill treatment to his wife.
He said the alleged case of the having abetted his wife to commit suicide was
misconceived as she had not died of burns. His wife was not in a position to give any statement before her death and the one shown to have been recorded by police was the result of an "after thought", he added.
He said if he was not released on bail, his three minor children would die of starvation as there was nobody to look after him.
Doctors, who conducted autopsy on the body, were said to have deposed in the court that the woman had died due to septicaemia and not of burns and that she was not in a position to make a statement before her death.
After hearing the two sides, the judge said though the allegations against the petitioner were of heinous nature, he was presumed to be innocent until he was proved guilty. Nothing was shown that he, in the event of bail, might flout the conditions of bail, or prevail over prosecution witnesses.
A case for grant of bail was, therefore, made out in favour of the petitioner and
he was ordered to be released on bail, subject to furnishing of a surety of the amount of Rs 50,000 and a personal bond of the like amount on the condition that he shall remain present with the trial and not harass, or intimidate the remaining prosecution witness. In the event any such objections were raised by witnesses, the concession of bail granted to him shall be withdrawn, the judge directed.
