Court denies bail to Gola Shah | | | early times report JAMMU, May 23: Chief judicial magistrate Jatinder Singh Jamwal today dismissed the bail application of Ravinder Gupta alias Gola Shah who was arrested in an alleged case of fraud and forgery. The case was registered against him at R S Pura police station under sections 419, 420, 467, 468 and 471 of RPC read with section 120-B. After hearing the two sides, the CJM observed that the investigation of the case was still in progress and many a facts of crucial significance were still to be unearthed as all the accused, excluding the applicant were yet to be arrested. It was noticed that the allegations against the accused were that he prevailed upon an individual to impersonate as one Gurvinder Singh before munsiff, R S Pura, and execute an attorney in favour of the accused Gurmez Singh with regard to 70 marlas of land situated at Greater Kailash and thereafter on the strength of the said attorney and a document of sale also came to be executed. In this manner, the applicant along with other co-accused caused wrongful loss to the complainant and wrongful gain to themselves and without commenting anything on the merit of case. It is pertinent to notice here that after going through the material available on record that the allegations against the accused appeared to be well founded and in the given circumstances, it was not possible to accept the plea of the accused that he had been wrongly framed in the present case. With these observations, the court dismissed the bail application |
