| Teacher, assistant acquitted after 19 years for misappropriating Rs 300 | | | Jammu, Jan 30 Special Judge Anti-corruption Jammu J R Kotwal acquitted Ghulam Haider the then teacher Govt Higher Secondary School Malhar for misappropriating Rs 300/- and Pritam Lal Bhagat the then Field Assistant of District Social Welfare Office Kathua for facilitating the misappropriation by destroying the relevant record. According to the Vigilance case that during the year 1987-88 accused Ghulam Haider was entrusted with Rs 22000/- received from Social Welfare Office Kathua for distribution of scholarship to eligible pre-matric students. The accused allegedly misappropriated an amount of Rs 300/- by dishonest and corrupt means. It was further found that accused Pritam Lal Bhagat misplaced entire relevant record pertaining to scholarship in his custody and thereby facilitated the offence of accused teacher. While acquitting the accused Special Judge Anticorruption Jammu JR Kotwal after hearing CPO for the State and Advocate Sudershan Sharma and Riyaaz Choudhary appearing for the accused observed that the statement of prosecution witnesses is self contradictory and makes it impossible to draw a positive conclusion as to what according to the witness was paid to his son, such a statement is liable to be rejected in so far as his assertion as regard the money paid to his son is concerned. The Headmaster of the school of that time in his statement has referred to relevant entries in disbursement register of scholarship, this giving credence to the contention of the accused that both witnesses and Chain Singh and his father issued the receipt. The prosecution has failed to show from bulk of evidenced anything incriminating or relevant viz-a-viz against the accused persons. The accused held not guilty and therefore entitled to acquittal as such there is not even iota of evidence in support of charge affiants accused and the accused are acquitted after 19 years of investigation and trial of case for misappropriation of Rs 300/-. |
