EARLY TIMES REPORT
JAMMU, May 24: Principal sessions judge Jang Bahadur Singh Jamwal today acquitted LeT sympathisers -- Mohammad Amin, son of Mohammad Bashir, and Shakar Hussain, son of Mohammad Rafiq -- as the prosecution failed to connect them with the commission of offence.
They were facing trial in the case of enemy agent ordinance and conspiracy. Both hail from Dhanwan Kote near Chingus in Rajouri.
On June 15, 2006, Chingus police incharge Manzoor Ahmed received an information from a source that being an agent of militants, Amin was involved in anti-national activities. The sources also told police that he had in his possession documents pertaining to anti-national activities.
Acting on the input, police raided Amin's house at Dhanwan Kote and apprehended him some LeT documents were recovered from him. He was booked under section 3 of EAO and sections 472 and 120-B of RPC.During investigation, it was found that Amin and Shakar Hussain were fast friends and both of them had been working for LeT and providing secret information about movement of security forces to militants. Shakar was also picked up.
It was also found that unknown persons kept on visiting their houses and their activities were likely to cause harm to the country particularly J&K. On June 2, 2006, the accused had showed at a water spring a LeT threatening letter to Ghulam Hussain.
After hearing the two sides, the judge observed that there was no evidence that any such letter written on a page of LeT letter pad, containing any incriminating material was recovered from any of the accused.
There was also no evidence on record that the accused were found negotiating with any militant organization or any member of any such organizations or in any manner had any links with such organization and as such could not be held to be enemy agents.
There was also no evidence of conspiracy with any militant organization, or they had ever supported their cause directly or indirectly prejudicial to the interest of the country or the state.
With these observations, the court acquitted both the accused from the charges leveled against them.
