Confused' Interlocutors rule out autonomy, self rule But seek regional councils, restoration of Art 370

JAMMU, May 24: Finally the cat is out of the bag. The report of New Delhi's nominated interlocutors on Jammu Kashmir is finally out. The report has shocked the National Conference (NC) and the People’s Democratic Party (PDP) as well by ruling out restoration of autonomy and self rule. The report, in a way, has vindicated the stand of the separatists who chose to ignore the interlocutors.
While ruling out restoration of autonomy, the report said it will create a Constitutional crisis. However, the report recommends restoration of Article 370 in its original form. This reflects the `superficial' knowledge of the `confused' interlocutors viz-a-viz Jammu Kashmir. Autonomy and Article 370 (in its original form) are inseparable. And, when the report seeks its total restoration, it in fact is seeking restoration of autonomy.
The opening words of Article 370 merit a serious consideration. It reads: "Notwithstanding anything nothing in Article 238 shall apply to the State of Jammu Kashmir." The Article 238 dealt with Centre-State relations. According to this Article the head of the State shall be called Governor and the head of the administration Chief Minister. This did not apply to the State of Jammu Kashmir. To put it plainly, the head of the State in Jammu Kashmir was Sader-e-Riyasat and the head of administration Prime Minister. The Article (238) has been omitted from the Constitution decades ago. So by seeking restoration of Article 370 in totality, the interlocutors are in fact, seeking re-induction of Article 238 in Indian Constitution. And, if it is re-inducted, the nomenclature of the top posts in the State would change automatically.
The report also suggests a sort of self rule by seeking councils with legislative and administrative powers at the regional level.
