HC directive to Govt over contractual lecturers' petition | | | Early Times Report JAMMU, May 26: In a petition filed by 21 contractual lecturers who are working in different government colleges and were appointed under SRO 255 dated August 5, 2003, Justice Hasnain Massodi of high court today ordered to make benefits of the government order No 1661-GAD of 2009 dated November 26, 2009, in favour of the petitioners in accordance with rules. The petitioners have sought the implementation of government order No 1661-GAD of 2009 dated November 26, 2009 by virtue of which they are entitled for the revision of their minimum wages of Rs 21,600 per month in terms of sixth pay commission. According to them, even vide order dated January 4, 2010, the financial advisor/CAO higher education department recommended their case to the financial department but inspite of this recommendation, the government order No 1661-GAD of 2009 was not been implemented. Moreover, the finance department has authorized GAD to issue necessary orders regarding revision of pay scale in terms of sixth pay commission but again they are not implementing the same. They prayed that pending disposal of the main petition, the respondents be directed to implement government order No 1661-GAD of 2009 and give the minimum pay of Rs 21,600 to the petitioners along with the arrears. Justice Massodi, after hearing the two sides, issued notice to state through commissioner/secretary higher education, commissioner/secretary finance department, commissioner/secretary GAD and director colleges higher education returnable within four weeks and ordered that in the meantime the respondents would accord consideration of the petitioners' case and make benefits of the government order No 1661-GAD of 2009 dated November 26, 2009 in favour of the petitioners in accordance with rules and directed Registry to list the case after service is complete. |
