Hard decisions like appointing true warriors as leaders, abrogating Indus Water Treaty are need of the hour

In the aftermath of attack on Indian parliament in 2002 by terrorists exported by a neighboring ingrateful , unpeaceful , poor and downtrodden country , there was a voiceferous demand from various people in India for abrogating Indus water treaty . This treaty was signed by then Indian prime minister Pandit Jawaharlal Nehru and his Pakistani counterpart on nineteenth September ,1960 . This Indus Water Treaty between India and Pakistan has caused ripples within India for weakness of then Indian policymakers agreeing to indefinitely reserve four-fifths of the total waters of the Indus system for Pakistan . Such huge and blatant reservation of waters of river Indus for lower riparian party that routinely indulges in indiscriminate firing on Indian border posts and exports its only homegrown commodity of terrorism to India is very bad because it reduces the availability of water for use of Indians . This treaty is particularly bad for Jammu and Kashmir state because due to this discriminatory treaty J & K is not able to use its own water that flows through heart of J & K . Our state can produce upto 20000 MW of hydo electric power but is able to generate very less due to the fact that for every hydro power project , undue permission from neighbouring country is needed. This situation is not healthy as far as our state is concerned . When state of Punjab can unilaterally terminate its agreement with Harayana and Rajasthan over the sharing of waters from river Ravi and river Beas then why Jammu and Kashmir with a far more genuine grievance has never been able to raise pitch for abrogation of Indus water treaty that disallows J & K for adequate storage of water from rivers of Chenab , Jhelum and Indus. Indian policymakers should have learnt from the mistakes of 1948 when Pakistani kabali raiders had infiltrated India and when Indian forces were on the verge of liberating POK , then God knows why Pandit Nehru then PM of India took this case to United Nations . This mistake and weakness of Pandit ji has caused India much trouble and even in signing of this Indus water treaty large volume of water flow from three western rivers namely Chenab , Jhelum and Indus has been ensured indefinitely to Pakistan without caring for any future agricultural , irrigation and water storage needs of teeming population of India . It has to be noted that whereas Madam Indira Gandhi was an iron lady for India who showed her capability in 1971 Indo Pak war , Pandit ji couldnot provide same kind of leadership to India from purely military point of view . Even while Pandit Nehru took care of building dams etc , he didn't take care to modernize Indian military and thus India got defeat from China in 1962 . Many defence experts have opined that even in 1962 battle with china , then Indian leadership under Pandit Nehru had disallowed usage of air power against invading country of China and very coward kind of logic was propounded that if India launches air attacks on China , then Chinese will also attack Indian cities. Now this logic is very poor because in battles blood falls on both sides and if leader of nation that is on war decides to abandon one wing of defence , then result will be like 1962 debacle. And it is said that in 1962 , Indian air power was much superior to that of China and we could turn tables on China at that time had we used our air power to maximum. It is my humble opinion that only true warriors should be chosen as leaders of nations and such true warriors should honour time tested Kshyatriya tradition of India . The concept of Kshyatriya is very simple and it is beyond purview of any one community i.e. pandits cannot decide who is kshyatriya or who is not . This decision can be based only on the sword. I have read that King Shivaji who carved his own kingdom within life time of Aurangzeb had to call some pandits from north India for his coronation . Its my humble opinion that King Shivaji should have got himself corronated by the strength of his sword as he was a true warrior or kshyatriya of India who stood against tyranny , rape , plunder and loot of his times. Now in our country there are lot of myths and lies propagated by various communities over a period of time but such myths or lies cannot stand against simple and plain hard facts. For example , Prof Baldev singh Panthi has clearly mentioned in his article on castes about various castes of Panjab viz. Jats , Mazhabis or ramgaria , khatri etc and he says that Jats are landowning caste primarily engaged in agriculture and khatri and Arora caste is primarily a caste of businessmen engaged in trading , shops , business etc. Further he mentions that castes are there but all are equal . This fact should be remembered by all and being a merit based person , I humbly opine that we Indians should choose only those warriors or kshyatriyas as leaders of our country who can defeat enemy and take India forward. In my opinion THE ROYALE GUPTAS , THE ROYALE MARATHAS and THE ROYALE TAMILS are the best kshyatriya warriors who can deliver our nation from various evils . It is to be noted that we cannot choose those who get defeated quite often or who refuse to take hard decisions when nation needs such decisions. The example of Israel is in front of us where the top leaders are themselves commandos who have served their nation in various capacities . Our nation when under attack from terrorists in 2002 when our supreme parliament was attacked did not do much . Then Prime Minister Atal Bihari Vajpayee ji mobilized Indian army and kept it ready for many months but couldn't take decision to launch attack. At that time also there was demand for scrapping of Indus water treaty and even that was not done. Let us remember that there has not been a single attack on America after the infamous world trade tower bombings and it is because America took very tough measures against the terrorism sponsors and hit them hard . It is beyond comprehension why India doesn't take such hard measures against the terrorists. I had an opportunity to talk to one young army officer who said that it is a pity that Indian soldiers are routinely killed by terrorists and there is no way to prevent it except by launching full scale attack on terrorism and their sponsors . I believe that In 2002 , PM Vajpayee ji should have shown some guts and either scrapped Indus water treaty or launched attack on Pakistan . Diplomatic measures cannot force any nation to abandon terrorism . It is only the military solution along with political solution that can give results. And as India didn't learn from previous mistakes , India had to face infamous Mumbai attacks where about 300 innocent Indians were killed by coward kind of terrorists who had come running to India from their poor and downtrodden country .
Let me now give some details of Indus water treaty and expose its drawbacks and the benefits of scrapping it . The Indus system of rivers comprises three Eastern Rivers (Ravi, Beas and Sutlej and their tributaries) and three Western Rivers (Indus, Jhelum and Chenab and their tributaries). Under the Treaty, the waters of Eastern Rivers are allocated to India. India is under obligation to let flow the waters of the Western Rivers except for the Domestic Use, Non-consumptive use, Agricultural use as specified, Generation of hydro-electric power as specified . Further India has been permitted to construct storage of water on Western Rivers upto 3.6 MAF for various purposes.India has been permitted Agricultural Use of 7,01,000 acres over and above the Irrigated Cropped Area as on 1.4.60. Under the Treaty, India and Pakistan have each created a permanent post of Commissioner for Indus Waters. They together constitute the Permanent Indus Commission , which is entrusted with the implementation of the Treaty. The PIC is required to hold meetings and tours and submit report on its work to the two Governments every year. India is under obligation to supply information of its storage and hydroelectric projects as specified. India communicates as a gesture of goodwill, flood data to Pakistan from 1stJuly to 10th October every year, to enable them to undertake advance flood relief measures. The arrangement is reviewed every year. Now lets see if it is legally possible for India to unilateraly scrap this treaty . Many claim that India is bound by the treaty . But why should India as an independent democratic nation be bound by some treaty that is found to be discriminatory for Indian people . XII (4) of the Indus water treaty rules out a unilateral termination. It provides that it can only be terminated on the basis of another treaty concluded for that purpose between the two governments . But the 1969 Vienna Convention on the Law of Treaties entitles a nation to unilaterally scrap a treaty on a number of grounds and it entitles a nation to terminate/suspend the operation of a treaty as a consequence of its breach. While New Delhi has not charged Islamabd with violation of the treaty as such, it has argued for its termination on the ground that Pakistan has failed to honour its commitments under the Simla Agreement and Lahore Declaration.Another possible ground for scrapping it is the fundamental changes in the circumstances as enshrined in article 62 of the Vienna Convention. New Delhi has not invoked this so far, but has used this argument informally at international meets on water for rewriting the Indus treaty. Thus we find that if there is strong will on the part of political leadership , then this treaty can also be terminated . Even the shimla agreement signed between India and pakistan state that the governments of both the nations will resolve to put an end to conflict and hostilities and work for promotion of friendly and harmonious relation .But is Pakistan adhering to this agreement in letter and spirit. Can friendly relation be developed if one nation sponsors terrorism against another nation and kills innocent citizens by way of terrorist attacks like those of attack on Indian parliament in 2002 and attacks on Mumbai ? The strategic aim of Pakistan in Kashmir is to secure direct control over the water resources . Without this water supply, the enemy stands crippled. Hence it is time we hurt the adversary where it pinches the most. A few who argue that since we cannot construct immediate storage facility or possess capability to divert this water find it a fruitless exercise. They forget that strategic aims to fructify require long term planning. We need this water for ourselves; therefore Pakistan's proxy war presents a sound reason to walk out of an unfavorable treaty. Storage or diversion can be undertaken subsequently. Scrap the Indus Water Treaty forthwith - such courageous decisions are in the national interest. This is the best form of warfare if it can subdue the enemy without going to war. Thus India should immediately start building resorviors on the eastern as well as western rivers as mentioned in this treaty . These can prove very fruitful in times of war and also serve useful for Indian population in general . The state of J & K can immensely benefit by scrapping of this unfavourable treaty as the water flowing through the state canm be used for irrigation , power generation and various other purposes also. In times of war , these water reservoirs can be let loose on the enemy and if enemy launches nuke attack , then India should have such capability to annihilate the enemy and that should be end of the enemy . Thus , in the end my humble and learned opinion is that India as a democratic , peaceful , bountiful and secular republic should choose her leaders from amongst true kshyatriya warriors like THE ROYALE GUPTAS , THE ROYALE MARATHAS and THE ROYALE TAMILS and this list is not exhaustive . Let India shine and prosper and defeat the enemies .
