HC quashed order treating period of 'suspension' as leave | | | Early Times Report Jammu, May 31: Jammu & Kashmir High Court Jammu Wing today quashed a govt order whereby the period of suspension of Ex-Principal Govt Degree College Mendhar Prof SK Bhalla had been treated as on leave. Justice JP Singh of Jammu & Kashmir High Court Jammu Wing in a significant order today quashed Govt order No 360-HE of 2011 dated October 17, 2011 whereby the period of suspension of Ex-Principal Govt Degree College Mendhar Prof SK Bhalla with effect from October 8, 2010 to May 31, 2011 had been treated as on leave. While quashing the said order Justice JP Singh observed that the petitioner shall be treated to be on duty for the period aforementioned. After hearing Adv Sheikh Shakeel Ahmed for the petitioner and Vinod Bakshi Deputy AG appearing for the Higher Education Dept observed petitioner had been placed under suspension pending enquiry for remaining absent on September 28, 2010 when he was required to attend the meeting which was scheduled to be attended by the Minister of Higher Education. Court observed decision of the Govt to treat the period of suspension from October 8, 2010 to May 31, 2011 as on leave of whatever kind due to him is unwarranted, illegal and against the Civil Services Regulations. With these observations Justice JP Singh allowed the petition and quashed Govt order No 360-HE of 2011 dated October 17, 2011. (JNF) |
