5 SAC cases kept on board for June 8 | | | EARLY TIMES REPORT
JAMMU, June 6: The much awaited hearing of the 35 state accountability commission (SAC) cases commenced today in the second half in the court of Justice Hasnain Massodi. AAG Gagan Basotra requested the court to adjourn the matters as he had no instructions to argue as the petitions involved constitutional points and thus only advocate general (AG) could argue these matters. He submitted that the AG was in the process of making an application to the chief justice for clubbing of SAC cases of both the wings and for the constitution of special bench for hearing these cases. He also submitted that the state was yet to respond to these petitions. However the bench observed that the petitions involved the legal question as to the power of SAC to initiate suo-moto action or not and these petitions could be considered without any reply from the state government. The SAC counsel resisted the submissions of the AAG and said that because of various interim orders, the SAC functioning had come to a stand still. After hearing the two sides, Justice Massodi observed that it was strange as to why the state government was interested in prolonging these petitions which involved public interest. The court, looking into the urgency involved and the earlier directions passed by Justice J P Singh, kept all these petitions for hearing on June 8 with the observation that AG would remain present in the court for assistance so that these petitions could be disposed of accordingly. It is worthwhile to mention here that the petitions filed by Managt Ram Sharma, former deputy chief minister, Suman Lata Bhagat, former health minister, Peerzada Mohammad Syed, former education minister, Manohar Lal Sharma, minister for cooperatives, Vikas Behal, PRO to former health minister Suman Lata Bhagat, Satvir Gupta, former DIG, Atal Dulloo, commissioner/secretary to government, Abdul Majid Wani, former minister and MLA, Doda, Sheikh Rafiq Ahmed, former deputy commissioner, Rajouri, Dr Mohammad Din, retired commissioner of animal husbandry, Dr Satvir Gupta, former director sheep husbandry, Ashok Parmar, ex-JDA vice-chairman, Dharmveer Koul, PWD Executive Engineer, police Inspector Jamrodh Singh and Farhat Qureshi, ex-secretary of J&K housing board and others are pending in the HC for the last more than five years. Looking into the pendency of these matters, Justice J P Singh had issued various directions in public interest so that these matters were concluded for making SAC functional. |
