HC directs IGP to supervise probe in girl's abduction | | |
JAMMU, JUN 09 (JNF): Justice Muzaffar Hussain Attar of high court today directed police to conclude the investigation in the kidnapping of a girl with reasonable promptitude. The court observed that in order to ensure that investigation was brought to its logical conclusion, IGP, Jammu, was directed to supervise the investigation of the case. This direction was passed in a petition filed by the girl's father, seeking directions for the expeditious investigation by Bahu Fort police station so that his young daughter was recovered. The petitioner's counsel submitted that the offence under sections 366 and 109 of RPC was very heinous and as the prosecutrix had not been recovered till date, bail could not be granted to the respondent (accused) Tejinder Singh, son of Gurcharan Singh of Ward No 15, Mohalla Sheesh Mahal in Haveli, Poonch. He submitted that police were not functioning properly and they had not effectively interrogated the alleged kidnapper. It was also pointed out that because of laxity of the investigating agency, the investigation was moving at snail's pace. Justice Hussain, after hearing both the sides, observed that when a case for commission of non-bailable offence was registered, the investigating agency had statutory right on the basis of the material before it to arrest the suspect. The court expressed displeasure that from January 2012 till date, the investigating agency had failed to bring the probe to its logical conclusion and issued direction to the IGP to supervise the investigation.
