| HC issues notice to State in Porno-CD case | | | Jammu, Jan 31 Justice Mansoor Ahmed Mir today in a petition seeking CBI investigation in much publicized porno CD case filed by Narinder Kohli,issued notice to the State government through Commissioner/Secretary Home Department, DGP and Members of SIT, returnable within two weeks. In a writ petition filed by Narinder Kohli seeking direction to the State to transfer the investigation, in FIR No 24/2004 November 3, 2004 registered with Police Station Women Cell Canal Road Jammu for offences u/s 292/293 RPC section 4 Immoral Trafficking Prevention Act, Section 7 Cinematographic Act and section 67 of Information Technology Act, to the Central Bureau of Investigation for free and fair investigation. The petitioner also seeking direction to SSP Aziz Khan, Dy SP Ashok Sharma and Inspector of Police Lal Chand, Special Investigation Team not to torture the petitioner for compelling him to become approver during the investigation in the said FIR. In the petition it has been submitted that the said FIR was registered against one Ms Anara Gupta ex-Miss Jammu, who was already in the custody of police since October 24, 2004. After the registration of FIR, much hype was given in the media about the involvement of former Miss Jammu in the pornographic CD and the name of the petitioner was also dragged.It was alleged that it is the petitioner, who had got prepared the said CD. It was submitted that entire case was false and frivolous and absolutely false allegations were leveled against the petitioner, despite the fact that petitioner was not at all involved in the said case. In the petition it has been further submitted that petitioner surrendered before the police in the said case in November 2004 and was kept in confinement. Due to the media-hype, the entire controversy become talk of the country and the matter was reported in every newspaper and channels. Petitioner was defamed and his life was totally spoiled by the irresponsible police officers. Petitioner had to spend more than 50 days in confinement and was bailed out by the Competent Court. During the pendency of investigation a PIL came to be filed before the High Court seeking transfer of investigation to CBI. and the High Court was informed that the investigation has been transferred from Women Cell to Crime and Railways and Special Team was constituted. The Special Team and also investigated and interrogated the petitioner in detail. The entire investigation which was being conducted by Crime Branch headed by DIG Police monitored by the High Court and the Crime Branch ultimately informed the High Court that no case was made out and closure report was submitted before CJM Jammu. The CJM Jammu vide his order of January 21, 2006 desired the investigation in more detail and directed the DGP to entrust the investigation of the case to a team of officers.
