| HC stays Promotion of 101 Tech-III in PDD | | | | Jammu, June 16 (JNF) : In a writ petition filed by ITI Diploma holders Electrical Employees Association through its President S Jasbir Singh challenging the promotions of 101 Technician-III in PDD, Justice Mohd Yaqoob Mir of Jammu & Kashmir High Court Jammu Wing issued notice to Commissioner/Secretary PWD, Development Commissioner Power, Chief Engineer EM&RE Wing, PDD Jammu &101 private respondents including Subash Chander Shastri returnable within four weeks and after hearing Advocate Abhinav Sharma appearing for the petitioners, Court ordered keeping in abeyance of the impugned order No;CEJ/ADM/70th/DPC/09 of 2012 dated May 22, 2012 so far it pertains to private respondent No 4 to 104. In the petition, Adv Abhinav Sharma has submitted that the impugned order is not only violative of Govt order No 129-PDD of 1996 but is also violative of judgment dated February 9, 2012 rendered by Division Bench of this court holding that only those departmental candidates could be promoted to the post of Tech-III who possessed the qualification of matric with ITI and it further directed that all those who were not matric with ITI were promoted on March 31, 1998 were required to be reverted to various inferior posts. The petitioners have also alleged the violation of quota as 50% quota is to be given for promotion and 50% by direct recruitment and sought quashment of the impugned order. |
