HC stays order of Director CAPD | Retrospective promotions | | Jammu, June 19 (JNF) : The High Court today stayed the order of CAPD Director No 252-CAPD of 2012 dated May 26, 2012 whereby all the petitioners along with several others have been deprived of the benefit of retrospective promotions granted to them vide order No 87-CAPD of 2009 dated January 3, 2009. The petition has been filed by Nek Ram and 30 others employees of CAPD presently working as Junior Assistants/Salesman/Storekeepers/TSOs seeking quashment of the said order. Justice Mohammad Yaqoob Mir after hearing Advocate SK Shukla appearing for the petitioners, issued notice to Commissioner/Secretary CAPD and Director CAPD Jammu returnable within four weeks and in the meanwhile Court direction operation of order dated May 26, 2012 shall remain in abeyance. In the petition it has been submitted that the petitioners are in a loss vis-à-vis their counter parts of Kashmir Division. The petitioners in order to seek parity with their counter parts by filling writ petition before the High Court, the said action of petitioners seems to have annoyed the Director CAPD Jammu who in a totally illegal and arbitrary manner has withdrawn retrospective promotion granted to the petitioners by his predecessor in the year 2009 with effect from December 3, 1993 with the approval of Administrative Dept and seeking quashment of order No 252-D CAPD of 2012 dated May 26, 2012 issued by Director CAPD Jammu.
