Akthar killing sabotaged surrender plan of Delhi HC blast accused 6/21/2012 12:37:27 AM Asif Iqbal Naik Kishtwar, June 20: After sending strong feelers to the security agencies about his surrender, the Delhi High Court blast accused Chota Hafiz did not turn up on the scheduled day for surrender. False indictment of his colleague Akhtar Hussain in the killing of a member of the Territorial Army, Noor Mohammad is believed to be one of the reasons for Hafiz's change of heart. Noor Mohammad was killed under mysterious circumstances during the intervening night of 2/3-5-2012. After scrutinizing 21 minute 3 second conversation between police negotiator, Chota Hafiz and slain Akthar Hussain Shah, the name of an unidentified army major surfaced who sought help of former LeT terrorist Akthar Hussain Shah son of Abdul Rashid Shah resident of Merna Palmar and planted him as a source with Chota Hafiz. The 2nd conversation between the police negotiator and Chota Hafiz began on a dissent note as police negotiator accused Hafiz of backtracking from his promise. The HM terrorist Hafiz looking in a state of nervousness though stood by his words regarding his plan of surrender but showed some apprehensions over the manner Akthar indicted in the killing of Noor Mohammad. Hafiz put the blame on security forces for indicting their `well wishers' in false cases and feared that he (Hafiz) might receive ill treatment at the hands of security forces once he surrender. "My promise is genuine--- but what to do--- You people make those suffer who are with you --- and what if you people do this to me ", he asked. The negotiator while talking with Akthar who accompanied Chota Hafiz asked him to come back as the life which he had chosen was full of danger and thorns. Akthar while pleading his innocence blamed army major for his false indictment in the killing of Noor Mohammad who hails from his village. In his continuous talk with police negotiator, Akthar briefed him about his plan as to how all the Delhi High Court blast accused except divisional commander Jahangir Saroori planned to surrender, but blamed army major of creating hurdles in the surrender. He told the police negotiator that the condition of his family is not sound and he don't want to linger on in jail in any false case and further stated that he was trapped in army major's plan who first give him the support by sending Rs. 10000 and then backtracked from his commitment of accepting him as his agent. The negotiator tried to somehow motivate Akthar to surrender with the guarantee that no one will implicate him in false case. After being assured by police negotiator, Akthar agreed to surrender before police."I have also called on SP mobile as Hafiz is interested to surrender and it was he (Hafiz) who forced me to call SP sahib and talk to him about my surrender… And after finalizing the things on that day… we had decided to surrender before SP." Akthar told police negotiator on phone. Meanwhile, Chota Hafiz while pleading his innocence in Delhi High Court blast case said that he had never seen a place like Delhi so how could he execute the blast there. Hafiz also showed his nervousness over serving of NIA warrant at his home. He feels apprehensive that in case he was shifted to Delhi, it will be impossible for him to come out of jail. The negotiator while executing the skills of motivation informed Chota Hafiz that their involvement in Delhi HC blast case is based only on the statement of Dr. Waseem Akram Malik presently in police custody. "If even one among you surrender from HM and comes forward and contradicted his statement before court and sought proofs regarding your hand in Delhi High Court blast, he will break. Police negotiator further cautioned Chota Hafiz that Dr. Waseem is sure that no one among HM will surrender… Then who will contradict him… this is why he (Dr. Waseem) shifts whole blame on HM so that the case will linger on. After giving patient hearing to what police negotiator told him, Chota Hafiz once again made his mind to surrender. He also regretted that he wasted 9 precious years of his life in militancy. "You just remember one thing… If Akthar is safe than we all feel safe --- if anything wrong happens to him (Akthar) then no one among us will feel safe." Chota Hafiz made clear. Hafiz then agreed to send Akhter for surrender. But within 24 hours of the conversation , Akthar was claimed to be killed in an encounter with security forces in Palmar area of Kishtwar district during wee hours of 21st of May 2012 morning and thus the surrender programme was sabotaged. Chota Hafiz along with Amir Kamal and Junaid Akram Malik is wanted by NIA in Delhi High Court blast case. Insiders blames the prevailing groupism and infighting within different ranks of security forces in Kishtwar district which needs to be checked, beside need to initiate probe into the mysterious killing Territorial Army Jawan Noor Mohammad and in an alleged fake encounter led to the killing of Akthar Hussain. Hafiz: How are you--- Asalamualakum NEGOTIATOR : Walakum Asalam--- But you are a cheater… Hafiz: How are you? NEGOTIATOR : I am fine--- Dear you are a cheater… You are not trust worthy person… Your promise is false… Hafiz: My promise is genuine--- but what to do--- You people make the others to suffer who are already with you--- and what you people then did with us--- NEGOTIATOR : About whom you are talking--- Hafiz: I am talking about Akthar--- your friends make him to suffer--- NEGOTIATOR : what we people did with Akthar… Hafiz: they have unnecessary dragged him in false case--- you (Security Forces) kill your associate own and put blame on him (Akthar), Chota Hafiz is referring to the killing of TA Jawan Noor Mohammad. NEGOTIATOR : I have already tell you to inform him not to hide--- There is no need for him to hide--- then why he is hiding--- Hafiz: then where he (Akthar) did go if he don't hide--- they will put him behind the bars for ever… NEGOTIATOR : You listen to me--- if he did not commit any crime--- then why anyone put him behind the bars for ever… Hafiz: I heard that some army personnels and one civilian prepare to testify that it was Akthar who kill Noor Mohammad… NEGOTIATOR : I already told you that if he hides---- people will suspect him as murderer--- he must have come forward so that people will came to know that it was not he (Akthar) who kill him…. Hafiz: I will send him--- he was in Kishtwar yesterday and only returns back today… NEGOTIATOR : If he was in Kishtwar--- had he meet with anyone in Kishtwar…. Hafiz: with whom he meets their--- he told me that few people saw him and started chasing after him in a vehicle and he ran away… NEGOTIATOR : He must have approach to senior police officer--- if he had made a call to SP Sahib and intimated him about his whereabouts with the plea that I (Akthar) am not guilty of killing Noor Mohammad --- then why security forces are running after me… Then I (NEGOTIATOR ) will see who will run after him…. Hafiz: then what to do? NEGOTIATOR : You give him my number and told him to call me and I will see who will arrest him falsely… Hafiz: He (Akthar) is with me this time… NEGOTIATOR : where is he? Akthar: It was you (Security forces) who pushes me to wall again--- I am spending my happy days before now--- NEGOTIATOR : Who the hell ask you to join back--- if you don't kill Noor Mohammad, then why you are hiding there … Akthar: Did you know the Army Major---- it was he who told me to do this--- You know on that day when Noor Mohammad was killed, it was Hafiz who is planning to surrender… but we are in Dool (Name of place on the outskirt of Kishtwar district) --- than I call him (Major) and inform him that we are in Dool right now… I have also intimated him that Hafiz is also in touch with someone else though whom he wants to surrender--- I also told him once the things will get clear I will intimate him… As I am planning to call him (Major) again, but in the mean time they enacted a drama during intervening night and kill Noor Mohammad… Major told me to stay away for at least 5-10 days and when I inquired from him about the reasons, Army Major informs me that people suspect my hand behind Noor Mohammad killing… Major further intimated me that after few days--- he (Major) will inform the people that I (Akthar) am working with them and he will also intimate the people that I was on duty when the killing of Noor Mohammad took place… After few days when I call army major he told me that it is better for me to actively join the militancy… NEGOTIATOR : You don't have the mind--- if Major tells you that people blames you for killing of Noor Mohammad and you agreed… You must have come forward so that you can clear the things before public… People did not say it was army major who kills Noor Mohammad-They put blame on you…. Akthar: I know all this… now the people put blame on me… NEGOTIATOR : You must have come forward and say that I was in Dool when the killing of Noor Mohammad took place… you must say that why you people put blame on me for his killing… Akthar: I have also called on SP mobile as Hafiz is interested to surrender and it was he (Hafiz) who forced me to call SP sahib and talk to him about my surrender… And after finalizing the things on that day… we have decided to surrender before SP… Do you know Major … I plan to approach police on very first day about my innocence… but you know what happen--- He (Major) told me that in case I approach to police--- he was not in a position to do anything for me… He also told me to remain quit for 10 days and promises me that after 10 days, he will himself intimate the police that I am working for him and I was on duty with him when the killing of Noor Mohammad took place--- he also told me that he will prepare all the documents pertaining to my innocence on his own… NEGOTIATOR : You are a fool--- you did not understand that once you remain absconding for 10 days.. they will declared you as an active militant… They will show you as an active militant…. Akthar: I was in city then and he (Major) send me Rs. 10000/… what I tell you when he send me Rs. 10000… I thought that he is my well wisher and is doing well for me… He also told me that whatever financial help I required during 10 days, he will give me that… NEGOTIATOR : Than why you are not coming at front and clearly told him in presence of all that you told me all this and you are unnecessary implicating me in false case… You told him that you provides me Rs 10000 and now why you are falsely implicating me in killing case of Noor Mohammad. Akthar: My life spoils now… you know my life just started coming back on track as you are very well aware about my condition at home… I think I was trapped now and I think not to come back since I don't want to make my family suffer anymore… This is why I decided to remain quit… They all are planning to surrender before--- but now they all backtracked… I have never slaughtered a Cock in my life than how can I kill a person… That too hailing from my own area… NEGOTIATOR : You are spoiling your own life… Akthar: Lets listen… my program is very strong--- My plan is to hold meeting with all except Jahengir (HM Commander) so as to motivate them for surrender… NEGOTIATOR : Come back… you will get no benefit there--- except threat to his life… Akthar: If I come back-government will try to save his own people… How they will think about my innocence… they will again put me behind the bars and I cannot sustain that thing, as I don't have any will now left in me… NEGOTIATOR : If you don't have committed any crime.. Then why government will put you behind the bars. Where Hafiz had gone... Akthar: He is next to me… NEGOTIATOR : Give him the mobile… Akthar handed over the mobile to Chota Hafiz… NEGOTIATOR : where is your promise… it is totally a false… I don't believe that you will make a false promise with me… Hafiz: My promise was genuine… But what Akthar conveyed to you is creating tension in my mind… NEGOTIATOR : You tell him (Akthar) to call his family members and give them my mobile number so that I can arrange their meeting with SP. Hafiz: fine…. NEGOTIATOR : After meeting with him (SP) I will see how army will be able to register FIR against him (Akthar) … Hafiz: you just remember one thing… If Akthar is safe than we all feel safe --- if anything wrong will happen with him (Akthar).. than no one among us will feel safe… NEGOTIATOR : I already told you.. Just told him to contact his family members and tell them to meet me so that I can arrange their meet with SP. Then he will be safe… Hafiz: with the condition that you don't put him behind the bars.. NEGOTIATOR : Dear I have already promise the same with you… Hafiz: He must not be in jail… NEGOTIATOR : You send him first… if he will be put behind the bars--- then you don't come for surrender…. Hafiz: fine. NEGOTIATOR : If we set him free then there will be the problem in your surrender… Isn't it… Hafiz: If he was left free… then we all think about to surrender… otherwise it is a tuff call for us… NEGOTIATOR : Last time you told me to come and I came there and stayed till noon… Hafiz: I have seen your vehicle… I am watching you from a nearby house… The house just above you--- I was sitting there and watches you till noon… NEGOTIATOR : I am calling you… why don't you pick up the phone… Hafiz: I know then that you are calling me as my phone was ringing.. I am waiting for Akthar to come… and when he came, he narrated me about his story related to Noor Mohammad… NEGOTIATOR : Akthar was with you then. Hafiz: He arrived soon after you reach there… NEGOTIATOR : I am not aware about that.. You are not picking my phone and I think that you might not come… then I and SP Sahib left the spot at around 11.30 AM -12 Noon… SP sahib has accompanied with only two bodyguards at that time… Hafiz: Ya I have seen them… NEGOTIATOR : I am once again telling you that you will achieve nothing while sitting there (In forests) - You yourself tell me since how many years you are on run… Hafiz: 9th year in running… NEGOTIATOR : Then tell me what you have achieved in all these 9 years… Hafiz: What… nothing achieved… NEGOTIATOR : Neither you are able to go home, neither you are able to attend any function at home and neither you are able to meet family members… Hafiz: I feel tense about the NIA warrant sent at my home… NEGOTIATOR : That warrant doesn't matter once you come back… If you did not commit any crime.. Then the warrant is no problem for you… Hafiz: I am thinking if I was shifted outside Kishtwar (Hafiz referred to Delhi shifting by NIA in connection with his alleged involvement in HC blast)… then it will be a difficult situation for me… Hafiz: I have even not seen Delhi in dream… NEGOTIATOR : Whole world knows this… It was Juniad's brother who was arrested in connection with Delhi HC blast and it was he who in his statement told them (NIA) that HM carried out the blast… If even one among you surrender from HM and comes forward and contradicted his statement before court and pledge before the court to ask Dr. Waseem for proof regarding their hand in Delhi High Court blast like who give him the IED. You will see how the lawyers will gagged him.. You tell him before the court that it was someone else who carried out the blast and he (Dr. Waseem) is only malign the name of HM… Dr. Waseem knows that no one among you is coming… Hafiz: to contradict him… NEGOTIATOR : He (Dr. Waseem) is sure that no one among you will surrender… Then who will contradict him… this is why he (Dr. Waseem) shifts whole blame on HM so that the case will linger on… Hafiz: Ya… NEGOTIATOR : If any one among you stand in front of him and questioned him regarding the exert location where we (HM) handed over an IED to him… where HM executed the blast and who accompanied you (Dr. Waseem).. Hafiz : Ya that's true… NEGOTIATOR : You also tell him that we have never been in Delhi… than how could we people reach Delhi to carry out the blast… Hafiz: I fall ill during winter and I was even not able to shift Kishtwar for treatment.. NEGOTIATOR : If you remain quit in fear.. People will think that it might be you people who had carried out the blast since no one among you is ready to surrender… Hafiz: this is what the issue is all about… NEGOTIATOR : Leave aside all fear and psychosis… things can go like this… Hafiz: that's fine… NEGOTIATOR : Once you return back you will yourself witness and find the difference in life which you lead today and the life of the people living in city today. If you want to come, then come… otherwise it's your own will… Hafiz: that's true… NEGOTIATOR : anything else… Hafiz: Rest everything is fine… NEGOTIATOR : it is difficult to talk on phone.. You just meet me by face once only for about an hour… Hafiz: dear what I have to say… NEGOTIATOR : You tell me the time and place I will surely come … I you think I am coming to see you for the sake of promotion and instead hit (killed) me.. Hafiz: What you are talking rubbish like this… have you ever heard that I kill anyone in Palmar area… NEGOTIATOR : I am not telling you a lie… you fix the time and place I will surely come… Hafiz: You swear of your father that had I kill anyone in Palmar or even torture anyone… NEGOTIATOR : Ya I know you are not in Palmar area… I know you mostly remain confined to Marwah area… Hafiz: You even count any such incident in Marwah as well… NEGOTIATOR : ya I know that… NEGOTIATOR : You tell me where I have to come.. Akthar will than accompanied with me… Hafiz: Ok.. Done.. When you meet Akthar..
