Hold referendum in India to decide J&K fate
Interlocutors' Report
6/24/2012 1:06:21 AM
RUSTAM
JAMMU, June 23: The Delhi-appointed interlocutors' report was made public on May 24. Ever since then, Kashmiri commentators have been criticizing them. One of their complaints is that the interlocutors have distorted history by saying that "Jammu and Kashmir was a princely state, which was acceded to India by the virtue of a constitutional document, called Instrument of Accession, under the Indian Independence Act, 1947", as also by saying that "Maharaja Hari Singh, then supreme ruler of Jammu and Kashmir and the sole designated authority of the state, signed the Instrument of Succession on October 26, 1947". The interlocutors have committed no wrong. They were absolutely right when they said in their report that Maharaja of Jammu & Kashmir alone had the power to decide his state's fate in terms of the constitutional law on the subject. What Maharaja Hari Singh did on October 26, 1947 was what all the 560-odd princes did while taking decision on their respective states.
It is absurd that certain Kashmiri commentators have started saying that "Maharaja Hari Singh was an expelled owner of the state and his instrument of accession was null and void", that "it was later revised by Jawaharlal Nehru and Sheikh Abdullah mutually for temporary basis", that the "temporary accession was too violated by Nehru", and that Nehru "betrayed his friend and lodged him in jail taking the state under his control unlawfully". Such commentators are only fooling themselves by denying the stark realities, including the reality that the accession of Jammu & Kashmir with India was final and irrevocable" and that the Instrument of Accession signed by Maharaja Hari Singh was identical to the one signed by all other princely states. There was no different whatever.
Such commentators and almost all Kashmiri leaders say day in and day out that if peace is to return to the Kashmir Valley and Kashmir problem resolved on a permanent basis, the Government of India has to fulfill the solemn pledge that a plebiscite would be organized to decide the political fate of Jammu and Kashmir. They have been putting this outrageous suggestion despite the fact that Pakistan has violated the UN resolutions on Jammu and Kashmir. They know everything but still these Jinnahs have the audacity to insist on the otherwise redundant UN resolutions.
Anyway, let the Government of India hold a referendum to decide the fate of Jammu and Kashmir. The Government of India represents the entire Indian nation and it is the Indian nation that has to take a final call. In other words, the Government of India should organize referendum in the entire country, including Jammu and Kashmir, to ascertain if the Indian nation wants or doesn't want to let Jammu and Kashmir go out of India. People of rest of the country, like the people of Jammu & Kashmir, have their stakes in this part of the country and, hence, need to be involved in the exercise so that a right decision is taken and the so-called Kashmir issue resolved once and for all. Plebiscite or referendum just cannot be organized in Jammu and Kashmir alone. For, Jammu and Kashmir is integral to the Indian nation, which has suffered huge losses in terms of men and money during all these more than 65 years to protect the Indian sovereignty in this strategic part of the country.
There is another alternative available and the alterative is that the Government of India should create a situation in Kashmir that enables the votaries of referendum or plebiscite or Pakistan to cross over to the other side so that they are able to throw in their lot with the fanatics in the fast-crumbling Pakistan. Jammu and Kashmir is legitimately Indian and those who question this stark reality are welcome to quit Kashmir and go to Pakistan, which was created exclusively for the Muslims. If they believe that they would be able to tinker with the Indian sovereignty and achieve separation for Kashmir from India, then obviously they are living in a world of the past. The Indian nation is as it is and it will under no circumstances allow another communal partition of the country. But more than that, the religiously committed Jammu and Ladakh are very much there to defeat the evil designs of the fanatics and the votaries of two-nation theory. They know how to defend the national interest; they know how to defeat the fanatics. Revisit 2008 and see for yourself what Jammu really means.
