Court acquits murder accused as prosecution fails miserably | | | Jammu, June-25 (JNF) : Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal acquitted Vikram Singh alias Viky s/o Amar Singh R/o Nagrota and Ashok Kumar Chouhan S/o Bishambar Dayal Chouhan R/o Rewarhi, Haryana A/P Nagrota from the charges of committing murder of Dilbar Singh, as prosecution miserably failed to established its case against the accused. In the case under sec. 302/109 RPC, Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing both sides observed that the Court is satisfied that prosecution has not been able to establish the case where the guilt of the accused can be drawn and justified because all the circumstances are not found to be incompatible with guilt of the accused. There are lot of links missing in the prosecution evidence. The circumstances on which prosecution is relying upon connecting accused with the commission of offence have not been established conclusively. Accordingly, for the reasons discussed hereinabove, and law pertaining to the facts and circumstances of the case, Court is satisfied that prosecution has miserably failed to establish the case against the accused beyond any shadow of doubt. Therefore, challan fails and accused are acquitted of the charge framed against them. |
