DB orders status-quo | PIL regarding construction of Hall in Green Belt Park | | Jammu, June 26 (JNF) : A Division Bench of State High Court has ordered status quo in the PIL against proposed construction of a hall in the Green Belt Park at Gandhi Nagar. In a Public Interest Litigation filed by Raj Gopal Sharma against construction of big hall in Green Belt Park against the guidelines of master plan of Jammu 2021, a Division Bench of State High Court comprising Justice Virender Singh and Justice Mohd Yaqoob Mir ordered status-quo and granted four weeks time to Jammu Municipal Corporation for filing respond response. In the PIL, it was submitted that the petitioner find that respondent Director Floriculture has recently started raising a Pacca Structure in the form of Big Hall in the prominent area of Green Belt Park. According to the master plan for Jammu 2021 which has attained finality and sanction under law prohibits the erection of such pacca structure in Green Belt Park Zonal Area. The relevant guideline of Jammu Plan 2021 creates a legal bar and allows only construction of a dwelling shelter for watch and ward personnel. In the present case the proposed construction is being carried out in the form of Big Hall for commercial purpose which would have covered area of more than 62 Sqmts. The petitioner sought direction to Commissioner Secretary Agriculture Department and Director Floriculture not to construct the Hall and also sought direction to the JMC to demolish the Pacca Structure which has been constructed in the Green Belt Park Area illegally by Director Floriculture against the provisions of master plan for Jammu 2021. |
