Husband, Mother-in-law acquitted
Dowry Death Case

Jammu, June 26 (JNF) : Additional Sessions Judge Jammu Justice RN Wattal acquitted Rajesh Kumar S/o Anant Ram and Sakhtula Devi alias Kunti Devi W/o Anant Ram R/o New Plot Tali Morh Jammu who were facing trial in dowry death case for the last 10 years.
According to the police case that on 3rd September 2002 Smt. Sandiya W/o Rajesh Kumar R/o Talli Morh was admitted in GMC Jammu alleged to have taken poisonous substance and not in a position to give a statement. Sandiya died in the hospital and information was given to Police Officials by GMC authorities. On this information the proceedings U/s 174 of Cr.P.C were initiated.. From the inception of marriage the mother-in-law of deceased Kunti Devi used to taunt the deceased they also used to beat the deceased. Occasionally the deceased used to rush to her parental house as result of physical and mental torture at the hands of the accused and subsequently used to return back. On 3rd of September the accused beat the deceased, the brother of the deceased rushed to the house of deceased as it was found that she has consumed some poisonous substance and was vomiting profusely. The brother of deceased rushed her to hospital.
The accused tried to restrain her brother to take the deceased to the hospital. In order to save herself from the physical and mental torture the deceased consumed poisonous substance.
Additional Sessions Judge Jammu Justice RN Wattal after hearing both the sides observed that the prosecution witnesses have failed to establish that accused subjected Sandiya to cruelty and abetted her to commit suicide. Though Sandiya died within nine years of her marriage, the presumption of abetment to commit suicide in this case in hand therefore can't be drawn against the accused. In light of discussion, Court is of the considerate view that prosecution has miserably failed to prove that deceased Sandiya was subjected to cruelty and accused abetted her to commit suicide. The challan is therefore, dismissed. Accused are acquitted of the charges leveled against them.
