Court denies bail to 3 HM activists | | | Jammu, June 27 (JNF): Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal denied bail to Sheeraj Ahmed, his wife Faiza Begum and Ghulam Ali alleged activists of Hizbul Mujahdeen against all the accused FIR was registered. According to the police , accused Sheeraj Ahmed and Ghulam Ali have alleged committed offences u/s 120B RPC, 2/3 E & IMCO, 3 EAO, IFF Act and 3(3) P P Act and 17,18,19,20,21 U L Act and accused Nos. 1 and 3 are activities of Hijbul Mujahidin group of militants and crossed the boarder in Poonch in the year 2000 and 2004 and went to Pakistan for getting training and accused applicant No.1 Sheeraj Ahmed married to accused/petitioner herein Faiza Begum at Pakistan and thereafter all the three crossed over to India via Nepal thereafter to J&K State and were arrested by police. Police station Chankerkot who took them to JIC, Jammu. According to the police, on February 1, 2009 police station Chanderkot received an information that some militants with the assistance of employees of NHPC Baglehar with intention to damage the infrastructure of the Project thereby causing harm to the State as well as the country with unlawful activities. On the basis of this information, a case for offences u/s 120B RPC, 2/3 E & IMCO, 3 EAO, IFF Act and 3(3) P P Act and 17,18,19,20,21 U L Act was registered in the police station against accused Sheeraz Ahmed , Faiza Begum and Ghulam Ali. Accused Faiza Begum is involved for offences u/s 14 F Act, 3(3) P P Act. The offences alleged to have been committed by the accused within the ambit of Section u/s 14 F Act, 3(3) P P Act, 17,18,19,20,21 U L Act which falls in the category of 3 Enemy Agents Ordinance. While rejecting the bail Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing both the sides observed that Whoever is an enemy agent, or with intent to aid the enemy, does, or attempts or conspires with, any other person to do any act which is designed or likely to give assistance to the military or air operations of the enemy or to impede the military or air operations of Indian forces or to endanger life shall be punishable with death or rigorous imprisonment for life or with rigorous imprisonment for a term which may extend to 10 years and shall also be liable to fine. |
