| Court awards 3 years’ imprisonment to 70 year- old Hakim | | | Jammu, Feb 01
Presiding Officer TADA/POTA/3rd Additional Sessions Judge Jammu Wani ND today awarded three years Imprisonment and fine of Rs 5000 to 70 year-old unlicensed Hakim u/s 304 RPC, who prescribed medicine for one Babu Ram who died after consuming the same.
Court, after hearing APP Gulzar Singh Charak and counsel for the accused and considering the arguments and perusing the records of the case, observed that the accused is first offender and is an old man of 70 years of age and apparently seems to be poor and Sadu. So, he deserves a lenient view .In view of the circumstances of the case, he is sentenced to undergo imprisonment for three years and shall also pay fine of Rs 5000..
According to the prosecution story on September 13, 2000, the accused prescribed Desi medicines for the treatment of Knee Ache (arthritic) to one Babu Ram who after consuming the medicine started feeling uneasy and felt giddiness, so he was admitted to GMC Hospital Jammu and died there. The death of the deceased was caused because of taking of the medicine prescribed by the accused. Since the accused had no license, so case was registered against him and investigation was conducted, alleging that prima-facie case against the accused u/s 304 RPC has been proved. The accused has been charge-sheeted u/s 304 RPC on December 6, 2004. After about six years trial, today convicted and sentenced to three years imprisonment and Rs 5000 as fine. |
