1975 Accord was an incomplete exercise: Kamaal
‘Alliance with Congress unholy’

Jammu, June 28: The additional general secretary of National Conference, Sheikh Mustafa Kamaal besides challenging totality of accession has said that the 1975 Accord was not signed. In an interview with a newly launched monthly magazine in the summer capital, Kamaal said: "The exercise of the agreement was never completed. These are not my words only this was stated by former Chief Minister of the state Syed Mir Qasim in his autobiography."
Kamaal said, "I met him in New Delhi along with my brother Tariq Abdullah and discussed the issue. He was writing his autobiography at that time. We asked him about the 1975 Accord. He said the exercise was incomplete. Fact of the matter is that the two governments of Sheikh Abdullah and Indira Gandhi appointed one individual each to discuss the laws passed in the state by amending the state constitution from 1953 to 1974 and gave recommendation as to how these laws be restored in original according to 1953 position. Mirza Mohammad Afzal Beigh and G Parthsarthy worked out the formula that was to be presented to the two heads of their respective governments. Five issues were left to the principles Sadr-e-Riyasat, Prime Minister, Comptroller and Auditor General's jurisdiction, Election commission and Supreme Court's jurisdiction in Jammu Kashmir. The principles never met after Beigh and Parthsarthy had signed those recommendations that they had worked out. It is the enough explanation. It was not the issue between two individuals rather it was the issue between two governments. Even if they had met and for argument sake agreed it had to go to the respective cabinets for approval. And then if the cabinets had approved it or otherwise it had to be sent to legislatures of both the governments. But that exercise never took place and then India said that Sheikh Abdullah accepted all those laws passed between1953 to 1974. But there is no proof of that at all. Where is the proof?"
Kamaal said the attitude of the Congress and their dealings with the state right from 1953 had been mischievous. "The action of dismissing a popular Prime Minister in 1953 was the first blow to the National Conference. Since then Governor's rule has been invoked four times in the state without any justification. They have never been sincere towards National Conference. They stabbed Sher-e-Kashmir in the back not only in 1953 but in 1977 also. If the Accord of 1975 according to Congress had been agreed to by Sheikh Abdullah why did they bury it by removing him within eleven months of signing of the so-called Accord agreement? And then Mufti Mohammad Sayeed was made leader of the House. It was the constitution of the state that prevented to happen because the then Governor L K Jha despite pressure from New Delhi did not succumb. He said he had to defend the constitution of the state. He did not dissolve the house as recommended by the Congress government at New Delhi. He did not dismiss Sheikh Abdullah and kept the House alive which otherwise Mufti Syeed would have taken over power. He went by the constitution's article 92. It is an unfortunate, unholy and alliance of compulsion".
