Mad died after consuming medicine prescribed by accused
Court awarded 3 years Imprisonment to 70 years old Hakim

Presiding Officer TADA/POTA/3rd Additional Sessions Judge Jammu Wani ND today awarded 3 years Imprisonment and fine Rs 5000/- fine to 70 years old unlicensed Hakim u/s 304 RPC, who prescribed medicine for one Babu Ram who died after consuming the same.

Court after hearing APP Gulzar Singh Charak and counsel for the accused and considered the arguments and perused the record of the case observed that the accused is first offender and is an old man of 70 years of age and apparently seems to be poor and Sadu. So he deserves a lenient view to be taken against him. So in view of the circumstances of the case he is sentenced to undergo imprisonment for three years and shall also pay fine Rs 5000/-.

According to the prosecution story that on September 13, 2000, the accused prescribed Desi Medicines for the treatment of Knee Ache (orthortic) to one Babu Ram who consume the medicine and started feeling uneasy and he was also felt giddiness, so he was admitted to GMC Hospital Jammu and died there. The death of the deceased was caused because of taking of the medicine prescribed by the accused. Since the accused had no license, so case was registered against him and investigation was conducted, alleging that prima-facie case against the accused u/s 304 RPC has proved. The accused has been charge-sheeted u/s 304 RPC on December 6, 2004. After about 6 years trial today convicted and sentenced 3 years imprisonment and Rs 5000/- fine.
