| Selection of Excise Guards Challenged | | HC permitted petitioners to appear in the interview | |
Jammu, August, 01 ;In the 11 writ petitions challenging the notification of short listed candidates for the post of Guards, Justice YP Nargotra of J&K High Court Jammu Wing today after hearing petitioners in person issued notice to the respondent, in the meanwhile permitted the petitioners shall to appear in the interview on a date to be fixed by the selecting authority to be conducted for the post of guards for which the petitioners have applied. Court further said that the permission to appear in the interview shall be provisional. The final select list shall not be issued till further orders. Court further said that this order shall, however, subject to the alteration, modification and objections on motion. In the 11 writ petitions it has been submitted that Deputy Commissioner Commercial Taxes Department vide its advertisement notice April 2, 2005 invited applications for the posts of Guards and other class IV posts for Divisional Cadre Jammu and Divisional Cadre Kashmir. The eligibility criteria prescribed was that the candidate should be at least middle pass and physical standard in case of guards be not less than five feet and four inches with chest measurement 32 inches and with expansion not less than 34inches.
The petitioners applied for the post of guard for divisional cadre Jammu, the Excise Commissioner J&K, Chairman State Level Selection committee published the criteria/ methodology for making recruitment by notification June 19, 2006. The notification provided for the post of Guards, criteria fixed is based on height and chest measurement of the applicants. The short listed details of applications for the post of guards shall accordingly be published in the leading local newspapers. Thereafter, the selecting authority by notification July 12, 2006 published list of short listed candidates for the post of guards and notified the dates for conducting the interviews. The petitioners have not been selected. Their cases was that short listing has been done without conducting any physical tests of the candidates and therefore, is arbitrary and this apart criteria fixed for short-listing the candidates is illegal. Justice YP Nargotra after hearing petitioners in person issued notice to the respondents and in the meanwhile the petitioners permitted to appear in the interview. JNF
