PAK detenue's letter treated as Habeas Corpus
Petition disposed as detenue already deported

Jammu, July 7 (JNF) : A Pak National Detenue Abdul Qadir s/o Mohd Nawaz r/o Khairpur Tehsil Dipalpur, District Okara Pakistan had written a letter to Supreme Court of India and the same sent to the Registrar General J&K High Court. Based on which Secretary J&K High Court Legal Service Committee vide letter dated September 8, 2011 was asked the proposing action. On the detailed report prepared by the Secretary High Court Legal Service Committee, application has been diarized Habeas Corpus petition and while the matter was considered on judicial side on April 2, 2012 Mrs. ZS Wattali Deputy AG accepted notice on behalf of State and was directed to file response.
While the matter came-up for hearing before Justice Moham mad Yaqoob Mir, the state counsel produced a copy of Govt order dated August 18, 2011 where under in exercise of powers by the virtue of notification NO SO590 of 1958 dated April 19, 1958 issued by the Ministry of Home Affairs, Govt Of India and u/s 84 RPC sanction has been accorded to the deportation of four Pak National to their native country, which include petitioner Abdul Qadir s/o Mohd Nawaz and in compliance thereto said Pak Nationals including Abdul Qadir had been deported to the native country and a copy of memorandum has been produced which reveals that four Pak prisoners who were lodged in J&K, two in Central Jail Kot-Bhalwal, one in Central Jail Rajouri and one in P/S Hira Nagar were brought at ICP Attari Road under police escort by J&K Police for their repatriation to Pakistan. It is further revealed that after completion of all immigration formalities, the said Pak prisoners includes Abdul Qadir have been repatriated to Pakistan through BSF. Justice Mohd Yaqoob Mir after considering the copies produced, for the reasons stated above and in view of the position made clear in the aforesaid order and memorandum, nothing further survives for consideration in this petition and accordingly disposed of this petition.
