Court dismisses application of accused | Chopra Family Murder case | | Jammu, July 9 (JNF): In a much publicized Chopra Family Murder, counsel appearing for the accused Rajinder Singh has presented an application before the Principal Sessions Judge Jammu for deferment of recording the statement of the witness in view of pending of proceedings u/s 561-A CrPC before the High Court. Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal today observed that though the copies of pendency of the proceedings u/s 561_A CrPC before the High Court have been furnished but there is no such order restraining or stale of proceedings of this Court. Sr. Adv KS Johal appearing for the accused Rajinder Singh also could not substantiate that with the order of the High Court no proceedings can be stayed. Accordingly the application of accused Rajinder Singh is dismissed and the statement Vicky (Approver) is deferred. Before this Court observed that Special PP LK Sharma present, counsels for the accused are also present. Accused in custody also present, Vicky approver is present. No other prosecution witness is present today. Vicky approver has been brought from the separate jail than the other accused. Special PP LK Sharma shown his inability to examine the witness as the basic application of the accused made to the Court and order drawn therein for the approver is not traceable in the file. Upon this court said that let it be traced and be traced in the Court of City Judge Jammu also whether such application has been moved or not. With these observations Court directed Police that accused-approver Vicky shall be kept in the District Jail Kathua separately from the other accused.
