CB books fraudster, doctor for misleading Court

JAMMU, July 9: Crime Branch (CB), Jammu has registered a criminal case against two persons including a doctor for their involvement in the offences of cheating, fraud, forgery and criminal conspiracy.
CB booked the duo identified as Sanjeev Sharma son of Kewal Krishan of H No 777-F, Lane No 8, Talab Tillo, Jammu and Dr Mohit Gupta posted at Gandhi Nagar Hospital, Jammu for misleading the Court by producing a fake medical certificate.
According to CB sources, an application was filed by one of the accused Sanjeev Sharma (already an accused in case FIR. No 3/ 2004 titled CBI Vs. Sanjeev Sharma & Others) before the Principal District & Sessions Judge, Jammu seeking therein exemption from personal appearance on medical grounds for the hearing fixed on June 14 last, which was resisted by the prosecution (CBI) on the plea that the veracity of the medical record produced in the court in support of the application is required to be confirmed.
On this the Court directed the prosecution to depute some officer to ascertain the truthfulness of the medical record and accordingly an officer of the rank of Inspector was deputed who reported after verifying the records of the Gandhi Nagar Hospital that the accused was never hospitalized and that the medical certificate produced by the accused was false and fabricated. In this backdrop, the prosecution filed an application seeking therein enquiry against the accused persons mentioned above.
The said application was treated as complaint by the Court of Sessions Judge, Jammu and endorsed to the CJM Jammu for action under law through Crime Branch, Jammu. From the perusal of the complaint, it was found that accused Sanjeev Sharma in connivance with Dr Mohit Gupta had procured a false and fabricated medical certificate and produced the same with an application before the court of Ld. Principal District & Sessions Judge, Jammu seeking therein exemption from personal appearance on medical grounds in order to scuttle the process of law and to avoid framing of charges whereas the other accused Dr Mohit Gupta in sheer abuse of his official position had issued the false and fabricated medical certificate to Sanjeev Sharma in order to save him from the due process of law obviously for certain extraneous considerations.
A case against FIR No 16/2012 u/s 197, 198, 218, 420,465,468,471,120-B RPC r/w Section 5 (2) P.C Act, Svt 2006 has been registered and investigation was in progress.
