HC stays order of NHRC in mysterious death case

Jammu, July 13 (JNF): J&K State Challenged the order of National Human Right Commission in which the Commission issued notice to the state of J&K in a complaint filed by one Executive Director of Center for Dialogue and Reconciliation New Delhi in alleged mysterious death of Fiyaz Ahmed Khan, Justice JP Singh of Jammu & Kashmir High Court Jammu Wing after hearing Advocate General MI Qadiri with Adv GS Thakur appearing for the state of J&K observed that there appears prima-facie merit in the submissions of Advocate General, that the National Human Rights Commission New Delhi may not have jurisdiction to entertain any complaint on the subjects falling in list-II of the Constitution of India in view of the provisions of proviso appended to section 1(2) of the Protection of Human Rights Act 1993 and case for consideration of petition is therefore made out, the notice issued by the National Human Rights Commission and proceeding before the National Human Rights Commission New Delhi are directed to stay until next date.
