| BAJ to suspend work on July 20, 21 | | |
Jammu, July 14 : (JNF) : Bar Association Jammu has decided to observe strike on July 20 and 21 to protest J&K State Govt's passing of The Jammu and Kashmir (Residential and Commercial Tenancy Act-2012), by virtue of which J & K Houses and shops Rent Control Act has been repealed.
Today in an executive meeting of the Bar Association Jammu held under the chairmanship of its President Sr. Adv BS Salathia in which it has been decided to suspend work in all Court including High Court on July 20 and 21.
In the meeting Advocate B.S.Slathia, President Bar Association Jammu welcome the decision of the Kashmir Bar Association, who intend to lodge protest on the ibid issue. The executive committee of the Bar Association Jammu passed a resolution against the passing of J&K (Residential and Commercial) Tenancy Act 2012 by the State Govt.
The members expressed their views that the J&K (Residential and Commercial) Tenancy Act operates to divest the Civil Courts of their powers to judiciously adjudicate the disputes arising between landlords and tenants and vest them with the Assistant Commissioners and Tehsildar across the State. The members resented the enactment of the said legislation to vest the Assistant Commissioner and Tehsildar of settling the intricate disputes inter-se the landlords and tenants which involves interpretation of different laws and acts and these Officers lacking the legal expertise would only aggravate the already suffering litigant public. The executive committee to protest against passing of J & K (Residential and Commercial) Tenancy Act 2012 decided to suspend work on 20th & 21st July 2012 by terming the said Act as illegal, unconstitutional and against public interest. Further, it constituted a committee comprising of R.K.Kotwal, Pawan Manni, Sh. Sandeep Singh, Sh. Ajay Sharma and Sh. Rajesh Thappa, to examine the legality, constitutionality and proprietary of the Act supra on the Judicial side and render their opinion, by informing the Bar Association Jammu for taking appropriate legal action in the matter. It was also decided in the meeting to appeal all the Bar Associations across the State and members belonging to legal fraternity to abstain from working in the Courts on 20th and 21st July 2012. It was further decided in the meeting that any contemplated move of the state Govt. in divesting of powers of Presiding Officer Motor Accidents Claim Tribunal in short (MACT), Traffic Magistrate from adjudicating of the disputes relating to claim/challans and vesting the same to the bureaucrat has been viewed seriously by the Bar Association Jammu in particular and members of the legal fraternity across the State and shall be fought tooth and nail. The meeting was attended by Office Bearers of Bar Association Jammu M.U.Salaria (Vice-President) Parimoksh Seth (Joint Secy), Sandeepa Sambyal (Treasurer), Rohan Nanda (President YLA), S. D.S.Saini (Former President), J.R.Arora, C.M.Sharma, Sh. Pawan Manni, S. Baldev Singh, B.S.Sudan, Ravinder Sharma, J.P.Gandhi, Ajay Sharma, Smt. Asha Koul, Rajinder Singh Jamwal, Sh. Rajesh Thappa, P.S.Parmar, H.C.Jalmeria, Sh. Sandeep Singh, R.K.Kotwal, R.K.Dullo, Minu Koul, S. Jaspinder Singh, Anwar Chaudhary, M.P.Kapoor and many others. |
