Inquiry initiated against Nursing Home for alleged forced 'delivery'
Rural, Urban ministry asked to clear files of private Nursing Homes: Health Minister

JAMMU, July 16: Inspite of the two years ago judgement of Supreme Court for sealing of all unregistered Nursing Homes, surprisingly the number of same has increased manifold and many are found practicing highly unprofessional and unethical medicare like forced deliveries for their vested interests.
The bizarre reality came to light when Directorate Health, Jammu replying to a RTI filed by RTI Convenor Balvinder Singh, stated that only seven Nursing Homes in Jammu division are registered with the Government while the registration procedure for around 28 Nursing Homes is under process.
The registered healthcare institutes include Gupta Hospital and Research Centre, Kathua, Kristu Jyoti Hospital, Samba, Samba Medical Hospital, Rotary Eye and ENT Hospital Udhampur, M/s Mata Santo Devi Hospital and Research Centre, RS Pura, Rampal Charitable Nursing Homes and Research Centre, Channi Himmat, Swami Vivekanand Medical Mission, Amphalla.
The Deputy CMO in his reply vide ref No. DHSJ/PIO/10537 claimed that 31 complaints were lodged with the office of Directorate Health after they do not get mandatory information from nursing homes as per norms, apparently, they are not registered. Pertinently, Supreme Court of India in its directions in May 2010, had given June 11 deadline to the Nursing Homes to strictly comply with the laid down norms.
Pertinent to mention here that feeling the heat of the apex court's notification a petition was filed by Yudhvir Nursing Home on behalf of the private nursing homes following which the Chief Justice SH Kapadia granted one month's time to the Nursing Homes in Jammu and Kashmir for completion of norms laid down by the nodal agency -the Nursing Supervisory Authority working under the aegis of Directorate of Health and concerned Ministry. Meanwhile, when Health Department started drive for seizure of unregistered nursing homes, four nursing homes which included Astha Nursing Home, Ankur Clinic, Madaan Nursing Home and Medi Aid got stay order on the plea that since the nursing homes were established prior to the establishment of Local and Urban bodies and are in residential areas, therefore, it took some time to manage two kanals land prescribed in nursing homes norms, besides other infrastructure.
The matter of unregistering of Nursing Homes embroiled again when a complaint was lodged by one Gourav against a Rehari based nursing home, running under the name and style of 'Green Court Maternity and Nursing Home' alleging the nursing home administration for forced delivery by one Dr Sapna Khullar. Aggrieved Gourav, filed an RTI application against Nursing Home Authority for inquiry report conducted by Commission.
For inept the things came to light when Gourav filed complaint when nursing home refused to provide him medical claim of her wife's delivery. Getting suspicious, he started digging out the matter and taking out the same at professionals hands also. During discussions he showed the prescriptions to medical experts who cautioned him about the medicines prescribed by Dr Sapna Khullar which included 'mifepristone' a medicine induced for the forced /early delivery at the month of 8.
Irked and agitated over this, Gourav then got the root behind using this medicine as actually Dr Khullar wanted to go to America and to fleece money from Gourav. Gourav had paid Rs 36000 to the concerned doctor for handling the case.
Meanwhile, Gourav lodged criminal complaint against her in court and with dispute redressal commission as well.
Though, the Dr Sapna in her proof of administering tablet attached a copy of research conducted in GMC hospital with the reply.
Meantime, the agitated victim has registered a RTI application in this regard in which it was stated that the said nursing home is unregistered. The revelation came out in a report from Directorate Health in reply of RTI application No DHPSJ/PIO /7860. The complainant lodged complaint to Department of Administrative Reforms and Public Grievances and the case was forwarded to Jeet Lal Gupta, Secretary ARTRGPG, Government of Jammu and Kashmir.
When contacted Minister for Health and Horticulture Sham Lal Sharma told over phone that Ministries concerned i.e. the Urban and the Local bodies have been asked to clear the position to justify which nursing home is allowed for registration. Minister further added that earlier complying the SC order six nursing homes were seized. "The matter is to be taken up shortly, he added.
Meanwhile, Director Health, Madhu Khullar also said that a circular to the private nursing homes has been issued regarding their mandatory information to the office of Directorate Health for further action. And the department is conducting surprise visits to monitor the health care centers, she said, " adding, " to end the malpractice by some vested hands.'
At the same, Secretary Health MK Dewidi referring to the forced delivery case said that an inquiry against doctor in question will be conducted.
