Pre-arrest bail denied to accused in attempt to murder case

Jammu, July 17(JNF): Principal Sessions Judge Jammu Mr. Jang Bhadur Singh Jamwal today rejected pre-arrest bail application of Vipan Massi and Haldy Nar allegedly involved in attempt to murder case and withdrawn the interim order dated July 10, 2012.
According to the police case that the police has registered the case FIR No. 108/2012 U/Ss 307/341/323/147/148 RPC & 4/25 Arms Act on the statement of injured Satnam Singh, who was admitted in the Emergency Ward of Government Medical College and Hospital, Jammu on 29.6.2012 and the said case was registered on 30.6.2012.
The injured has stated that he was on his way to his house from his place of work and when reached at Exchange Road, Jammu, the petitioners along with three other accused stopped his way having a mutual criminal conspiracy. The petitioner Halday Nar brought out a 'kirch' and stabbed him in his stomach and the petitioner Vipan Massi hit him with a 'darati' on his head as a result of which he sustained serious injuries.
The other accused started hitting him with fists and blows due to which the complainant was further hurt. On the intervention of some passersby, the petitioners and other accused fled away from the spot leaving him there with blood oozing out profusely from the wound in stomach and he was shifted to the hospital in a serious condition by the passersby.
Perusal of police report reveals that the petitioners are main accused in the case and they are still at large and are required to be arrested as the weapons of offences are yet to be recovered from them.
Principal Sessions Judge Jammu Mr. Jang Bhadur Singh Jamwal observed that the crime rate considerably increasing day by day and the accused like present accused (petitioners) are seeking protection of the Courts after committing the heinous offences and got escort free and in case such kind of practice by the petitioners/accused is not prevented there is likelihood of creating chaos in the society and the life of the common man is not out of danger Scanning of the case diary as well as the police report has emanated that the petitioners after the commission of such a heinous offence are at large and are seeking protection of pre-arrest bail.
Accordingly, the pre-arrest bail application of the petitioners is dismissed and it be consigned to records. Interim order dated 10.07.2012 shall stands withdrawn.
