CJM defers Shopaian "rape, double murder" case hearing till August 19 | | | Bashir Assad Srinagar, July 17: Shopaian "rape and double murder" case which was listed for hearing Tuesday before Special Judge CBI (Chief Judicial Magistrate Srinagar) was deferred till August 19 as the special prosecutor CBI could not attend the court for unknown reasons. Neelofer w/o of Shakeel Ahmad Ahanger and Asiya of Shopaian were allegedly raped and murdered by unknown persons in May 2009 in South Kashmir's Shopaian district after which protests erupted in valley forcing Omar Abdullah led coalition government to order probe into the case. Case was being investigated by a Special Investigating Team (SIT) of Jammu and Kashmir police headed by the then DIG police Rouful Hasan and simultaneously a PIL was instituted before High Court at Srinagar by Kashmir Bar Association. In the meantime case was transferred to CBI for re-investigation. CBI submitted its report indicting 2 complainants (relatives of the victims), 6 doctors who performed postmortem of the deceased and prepared the report and 5 lawyers who pursued the case in Shopaian Court. CBI during the course charge -sheeted Dr. Nighat Shaheen, Dr. G M Paul CMO Pulwama, Dr. G Q Sofi Deputy CMO Pulwama, Dr. Maqbool District Health Officer Pulwama, Dr. Nazia and Dr. Bilal, 5 lawyers namely M A Gattu, Muhammad Yusuf, Abdul Majid Mir, Mubarak Ahmad and Muhammad Altaf. Case was challaned before Special Magistrate CBI (Chief Judicial Magistrate Srinagar) and the complainant filed the application for re-investigation of the case through some independent agency other than CBI before CJM, however, CBI quickly filed the objections to the application and the accused doctors through their council Advocate Riyaz Khawar filed application before CJM asking CBI to give the report prepared by SIT to the accused and CBI has filed objections to this application also. Case was listed today before the court and the next date of hearing has been fixed August 19 as Special Prosecutor CBI S K Bhat could not attend the case however his junior Asifa Padroo was present in the court. |
