Bail denied to impersonator

JAMMU, July 24 (JNF):- 2nd Additional Sessions Judge Jammu Subash C Gupta today rejected the bail application of Rattan Kumar Raina S/O Late Raghu Ram Raina R/o Kabir Colony Talab Tillo Jammu who allegedly impersonated himself as a Brij Krishan Koul and sold three storyed building.
According to the police case that Crime Branch Kashmir, sent a letter alongwith original complaint for investigation to SSP, Jammu. It appears that SSP Jammu, sent the same to police station Janipur, for investigation.
Police Station Janipur, registered a FIR, vide no. 113/2010 for commission of offences u/ss 420/468/47`1/ RPC.
During investigation, offence u/s 419 RPC was also added. Allegations against the present applicant are that he impersonated himself as Brij Krishan Koul S/O Shanker Koul and sold three storyed building constructed over land measuring 1.2 Kanal, situated at Bagat Barzulla, Srinagar, against a consideration of Rs. 35.00 lacs, through brokers, namely Asssadullah Kambay and Javed Ahmed Mir. It is further reported that Rs. 15.00 lacs were paid by the complainant to the applicant, at Jammu, at the time of the execution of the sale agreement. Rs. 3.00 lacs were also received by the aforesaid brokers, from the complainant, for registration purposes.
Later on, complainant came to know that the aforesaid brokers, have cheated him by adopting deceitful means, impersonation and forgery. Complainant has been duped with an amount of Rs. 18.00 lacs.
During investigation, it was worked out by the Investigating Officer that the mobile contact numbers given to the complainant Mohd. Shafi Lala, were belonging to the applicant. Investigating Officer has reported that investigation is at initial stage.
Custodial interrogation of the applicant is required for recovery of the duped money and important documents from him.
2nd Additional Sessions Judge Jammu Subash C Gupta after hearing Adv Vivek Sharma appearing for the applicant whereas APP KA Qazi appearing for the state observed that this court has granted interim bail in favour of the applicant for the offences, wherein, punishment is not more than 05 years. Offences as registered against the applicant, detailed hereinabove, entail punishment, which may extend to 07 years. Undisputedly, same are non-bailable as per Schedule-II, appended to J&K Cr.P.C. Heinousness and gravity of the offences, allegedly committed by the applicant, can be inferred from the allegations, as made against him in the matter.
He has duped the complainant with a huge amount of Rs. 18.00 lacs, by adopting deceitful means, impersonation and by committing forgery.
Undisputedly, custodial interrogation of the applicant is required in the matter. Court is of the of considered opinion that applicant is not entitled for extension of interim bail, earlier granted, any further. Accordingly, his interim bail, is not extended any further, with the result, application in hand stands dismissed.
