| DB admites appeal, directs status-quo | | Pre-mature transfer of SE BRTF | | Jammu, July 27 (JNF) : In a LPA (appeal) filed by Superintending Engineering, working as Commandant 50 BRTF challenging the judgment of writ court whereby writ court had dismissed the petition holding that transfer is an incident of service, Division Bench of Jammu & Kashmir High Court Jammu Wing comprising Justice Virender Singh and Justice Mohd Yaqoob Mir after hearing Sr. Adv BS Salathia with Adv Ashish Sharma and KK Pangotra ASGI for Union of India and Sr. Adv DS Thakur with Adv Aruna Thakur admitted the appeal to hearing and in view of certain vital issues raised by Sr. Adv BS Salathia,
Division Bench observed that in view of the peculiar facts and circumstances of the case, an effort shall be made to dispose off the appeal in the week commencing August 20, 2012. Division Bench also directed the maintenance of status-quo with regard to the status of the appellant S Mohan Singh Sohal Supt Engineer working as Commandant 50 BRTF as on date till final disposal of the main appeal. |
