Baig introduces Bills in LA

SRINAGAR, AUGUST 01 – Deputy Chief Minister Mr. Muzaffar Hussain Baig today introduces two Bills in the Legislative Assembly today.
First Bill L. A. No. 13 of 2006 provides to amend the Code of Civil Procedure Samvat 1977 while as second Bill L. A. No. 14 of 2006 provides to amend the Jammu and Kashmir State Legislature (Prevention of Disqualification) Act 1962.
LA Bill No. 13 seeks to incorporate provisions in the state code on the lines directed in the judgment of SC and also substitutes the words “Chief Secretary” by the words “Secretary to Government Incharge of the concerned department”.
LA Bill No. 14 seeks to exclude various offices from disqualification. New clauses (h) and (I) have been incorporated in section 3 of the said Act to exclude the holders of various offices from being disqualified under sub-section (1) of section 69 of the state constitution. Further, the government has also been empowered to notify other offices in this behalf. In terms of clause 3 of the Bill, the amendment shall have retrospective effect and holders of such offices as are mentioned in the proposed clauses (h) and (I) shall not be disqualified as if the amended provision had been in force at all material times. The holders of the office shall be entitled to compensatory allowance as defined under clause (a) of section 2 of the principal Act and no remuneration attached to the office/post.
Various private members also moved for leave to introduce Bills in the House today. Mr. Qaiser Jamsheed Lone moved for leave to introduce “A Bill to amend the J&K Accountability Commission Act 2002”, Mr. Mubarik Gul moved for leave to introduce “A Bill to provide for Prohibition of Child Labour in the State”, Mr. Ajay Sadhotra moved for leave to introduce “Bill to provide Social Security to the old aged persons, widows, destitute and handicapped persons who have no source of income”, Mr. Yashpaul Kundal moved for leave to introduce “A Bill to provide The Constitution of Jammu and Kashmir (Amendment) Bill, 2006”.
The bills moved by Mr. Ajay Sadhotra and Mr. Yashpal Kundal were rejected by voice vote, while as the bill moved by Mr. Qaiser Jamsheed Lone was referred to the Select Committee of the House.
