9 years imprisonment to Pak national

Jammu, July 27 (JNF): Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal today awarded nine years imprisonment and fine Rs 10,000 to Noor Ahmed Baloch S/o Noor Hussian Baloch R/o Chak Zahir Peer, Tehsil Khanpur, Pakistan . According to the police case that accused Noor Ahmed Baloch a Pak National, was driving Motor cycle bearing No. JK02 G 3593 towards Bhaderwah from Doda on 26.10.04 at about 12.30 p m and a search party of police alongwith Army stopped motorcyclist at Galginder Nallah, who on his disclosure, disclosed his name as Noor Ahmed Baloch Code Rashid r/o Raheem Yar Khan Tehsil Khanpur, Pakistan and admitted himself to be H M Area Commander, and has obtained terrorist training in PoK and for the last three years is conducting terrorist activities. During search a China made pistol alongwith magazine, 6 live cartridges and a notebook were recovered from his possession.
On the basis of this report, police register the case, commenced investigation, after completion of investigation challan was presented.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing both the sides taking the cumulative effect of the evidence, Court is satisfied that case is proved against accused u/s 7/25 Arms Act and 14 Foreign Act. However, offence u/s 3 E A O is not proved against him and he is accordingly acquitted for the same. The accused Noor Ahmed is convicted under sec. 7/25 Arms Act and 14 Foreign Act and the accused/convict Noor Ahmed s/o Noor Hussian Baloch r/o Chak Zahir Peer, Tehsil Khanpur, Pakistan who has been convicted u/s 7/25 Arms Act and 14 Foreign Act, is sentenced for a period seven years and shall pay a fine of Rs. 5000/- under section 7/25 Arms Acts and in default of payment of fine, he shall suffer imprisonment for a period two months and he is further sentenced for a period of two years and fine of Rs.5000/- under section 14 Foreign Act and in default of payment of fine, he shall suffer imprisonment for a period two months. Both the sentences shall run concurrently. JNF
