Petitioner seeks enlargement scope of PIL, levels serious allegations against MP | PIL against Land-Grabbing by Politicians, Bureaucrats | | Jammu, July 27 (JNF): In the much publicized Public Interest Litigation against organized land grabbing by certain Politicians, Police officers and Bureaucrats occupying responsible position in J&K State, A Division Bench of State High Court comprising Justice Virender Singh and Justice Mohd Yaqoob Mir took on record the reply filed by petitioner Prof SK Bhalla to the third amended status report which had been filed by Divisional Commissioner Jammu. DB in view of the absence of AH Qazi AAG deferred this PIL for next week. In the reply filed through Advs Verinder Bhat and Sheikh Shakeel Ahmed in which the petitioner has submitted that the perusal of three status reports filed by Divisional Commissioner Jammu show as to how the respondents resorted to tailoring on each occasion just to suppress certain vital information from the High Court. In the initial status report, Divisional Commissioner preferred to remain mum over the illegal/unauthorized grabbing of 41 Kanals of State land by son of Sh. Madan Lal Sharma and there is no explanation in the subsequent status report over this omission. The first status report also did not mention the expunging of the Girdawari entries of one Vijay Kumar @Bubby over 50 Kanals of state land situated in village Suraychak Jammu. The petitioner has also submitted that on the complaint of one Col VS Mangotra (rtd) the State Vigilance organization conducted an enquiry regarding the illegal/unauthorized occupation of 92 Kanals and six marlas of State land situated at Village Karandi Khurd Tehsil Hira Nagar District Kathua by Ch Lal Singh ( Member Parliament Kathua-Udhampur-Doda Constituency). The SVO in its enquiry indicted the illegal occupant Ch Lal Singh and then Vigilance Commissioner vide his number SVO/06/PRK-63/05-SC/4605 dated April 24, 2006 sent his report to the Govt of J&K for further necessary action. The petitioner obtained the information from PIO SVO and it was admitted in the RTI reply that the matter was brought in the notice of the Govt and action taken report in the matter is still awaited from the concerned dept. In the reply the petitioner has further contended that he also flashed RTI to the General Administration Dept with regard to the action taken against Ch Lal Singh on the basis of SVO report and the PIO GAD vide his number GAD/RTI/471/2012 dated July 4, 2012 instead of providing the information declined the same and termed the same as"discloser exempted" u/s 8 (J) of J&K Right To Information Act 2009. The petitioner has further averred in his reply that in the last session of J&K Legislative Assembly both Revenue as well as Forest Ministers of the State Govt namely Raman Bhalla and Mian Altaf Ahmed admitted on the floor of the house district wise encroachment of state/forest land in state of J&K. The area of state/forest land under encroachment in the state as admitted by the aforesaid ministers runs into lakhs of Kanals and the state Govt has preferred not to initiate any action against the encroachers to retrieve the precious properties of the state. Similarly an organized mafia has encroached prime Nazool land of the state. The petitioner in his reply has prayed to Court to enlarge the scope of the instant Public Interest Litigation which is of great public importance. Division Bench after hearing Advocates Verinder Bhat and Sheikh Shakeel Ahmed for the PIL and AAG Gagan Basotra appearing vice AH Qazi deferred the consideration of this PIL for next week in view of the non-availability of AH Qazi, AAG.
