Bail denied to accused in kidnapping case | | | early times report Jammu, July 30 (JNF): In a filmy style kidnapping of a girl, Special Mobile Magistrate Electricity Jammu Balbir Lal Jaswal rejected bail application of one Sunny Sharma one of the alleged accused involved in kidnapping. According to the police case that father of kidnapped girl lodged a report with SHO P/S Nowabad stating that therein that his two daughters proceeded towards the zoo on July 12, 2012 at about 5:00 PM. Both the daughters were waiting for matador in between two boys namely Sunny and Sikhander both real brothers boarding on car forcibly took his one daughter and fled away. Second daughter has apprised him he searched the daughter but did not found. Police registered case and arrested Sunny Sharma. Special Mobile Magistrate Electricity Jammu Balbir Lal Jaswal after hearing Senior Prosecuting officer Anil Dev Singh Jamwal observed that when the accused are involved in the commission of offence which may to the lower punishment other than capital punishment or life imprisonment but such offence have impact upon society. The Court must have hesitation in exercising the discretion in favour of the accused though every case have its particular features and very case has to be judged on basis of material available ion the record and attending circumstances the jail is rule and bail is exception be followed in the case where the accused involved in commission of offence carrying even sentence of lesser than capital punishment. With these observations court rejected the bail application. |
