PIL against removal of tinted/black films from Vehicles of VIPs/VVIPs | DB directs Director State Motor Garages to remove films from Govt Vehicles | | early times reprot Jammu, July 31 (JNF): A Division Bench of Jammu & Kashmir High Court Jammu Wing comprising Chief Justice MM Kumar and Justice Hasnain Massodi today in a Public Interest Litigation seeking removal of tinted/ black films Vehicles including VIP/VVIPs, after hearing Sr. AAG Gagan Basotra with IGP (traffic) Muneer Khan who was present in person, directed State Motor Garages to remove black films from all the Govt Vehicles except Z Plus Category. This order was dictated by Chief Justice MM Kumar for the Division Bench in open Court and further directed Administrative Secretaries/Deputy Commissioners to ensure that instructions issued by Director State Motor Garages be complied with and in case there is any violation by any Govt servant, list of such like vehicles be prepared and be presented before the Division Bench. Regarding the private vehicles, Division Bench said that public notice be issued by Inspector General of Police (T) in two English, Hindi and Urdu papers and directed to complete this process till August, 2012. Thereafter, those vehicles who do not comply with the directions of Supreme Court as Division Bench of the State High Court, directed IGP Traffic to seize all those vehicles. Sr. AAG Gagan Basotra submitted that in last three months 11000 films were removed from the vehicles. DB directed Registry to list this PIL on September 3, 2012 and directed IGP to file status report. The PIL filed by doctors in the State High Court seeking direction to State respondents to stop registration of new vehicles in the State of J&K till some visible and actual measures are enforced to check vehicular pollution and other traffic violations. In the PIL it has been submitted by the petitioners namely Dr. Davinder Singh Jasrotia, Dr. Tejinder Kumar, Dr. Jang Bhadur Singh, Dr. Harsh Sharma and Dr. Kailash Chander submitted that million people died every year due to road traffic accidents and to the best of the information of the petitioners merely 1300 people have died and about 10,000 injured in road accidents in J&K in the passed 15 months. The Govt claims of providing efficient transportation system. According to official data 11 people lost their lives in about 5945 accidents in 2009. This is addition to 8199 persons who sustained injuries critical and minor in these accidents. In the PIL it has been also seeking direction to respondents to ensure strict compliance of traffic laws/ regulations and safety regulations that should be monitored by an independent authority as may be appointed/nominated by the Court and regarding Vehicular pollution which can cause lungs nitrogen oxides and prayed for stooped registration of new vehicles in the State of J&K till some visible measures are enforced to check vehicular pollution and other traffic measures. |
