DB issues various directions to State & ors | Petition regarding construction of Lawyers' Chamber | | Jammu, Aug 3 (JNF) : In a petition filed by Bar Association Jammu regarding the construction of lawyers' chambers, multi-level parking and alternate road for Court, Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Sr. Advocate BS Salathia (BAJ President) with Adv Ashish Sharma, Sr. Adv UK Jalali with Adv Shivani Jalali and Adv MU Salaria (Vice-President BAJ) appearing for the Bar Association whereas Gagan Basotra Sr. AAG appearing for the state whereas ASGI KK Pangotra appearing for the Union of India, Sr. Adv DC Raina with Adv Ananta Raina appeared for the JKPCC, observed that a Status Report with regard to the construction of Lawyers' Chambers in the District Court Complex containing has been filed. After perusal of status report it would reveal that on the lower ground floor and upper ground floor 34 and 35 chambers respectively have been completed and their possession has been handed over to the Bar Association. However, 26 chambers on the upper ground floor are yet to be completed and the work is in progress. Likewise, on the first and second floors, 61 and 57 chambers respectively are proposed to be constructed along with ATM, Bookstall, dispensary, Conference hall etc. Sr. Adv DC Raina appearing for JKPCC states that work is expected to be completed by January, 2014, Counsel has pointed out that there is some financial problem with the J&K PCC Ltd, due to non availability of funds. Up[on this Division Bench said that if any such problem arises, JKPCC would be at liberty to move appropriate application and the efforts shall be made to complete the work at the earliest possible. With regard to the proposal for construction of multi-level parking having connectivity with the chambers, state respondents namely, Financial Commissioner, Finance Department, and Commissioner/Secretary, Law Department, shall also file status report, since the land stands already earmarked. The Status Report be filed a week before the next date. Division Bench further observed that one issue which has been discussed in various orders proposes to connect High Court road with Jammu-Nagrota High Way Road. In various orders, it has been recorded that the Army authorities, in principle, have agreed for the construction of such road. However, in this regard, reports of the Registrar Judicial and the Secretary of Bar Association, Jammu have been placed on record indicating that there was some disagreement in implementation of the proposal. Pangotra, ASGI appearing for Army authorities states that the road proposed still involves some sensitive points of army units and, therefore, matter has to be viewed in that perspective. Division Bench said that Let a proposal be submitted by ASGI Pangotra which may achieve the connectivity of the High Court road to Jammu-Nagrota Highway, within four weeks. |
