PIL for appointment of translators in High Court

Jammu, Aug (JNF) : In a Public Interest Litigation filed by Pawan Kumar Maini a practicing Advocate and Ex-General Secretary of Bar Association Jammu regarding creation of post of translators from Urdu to English, Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Sr. Adv BS Salathia with Adv Vikram Sharma appearing for the PIL whereas Sr. AAG Gagan Basotra appearing for the state, observed that This petition raises an important issue, which has direct bearing on the disposal of cases particularly the criminal appeals filed by the accused against their conviction. On account of non availability of English translation of evidence, judgment and documents, the hearing of the appeals is hampered. It has been brought to notice of Division Bench that appeals filed by the accused are pending since 1999 in this court and it is travesty of the justice to allow the accused to continue to serve the sentence. The irony of the situation is that no post of Translator has been sanctioned by the respondent-State. There is urgent need of furnishing paper book with translation as same is required under J&K High Court Rules 1999 and issued show cause notice to Chief Secretary and Law Secretary as to why direction be not issued for creation of posts of Translators from Urdu to English, so that the work of preparation of paper book in accordance with the High Court Rules of 1999, is expedited and the dream of the constitutional framers for speedy justice is achieved by early disposal of the cases. Right of speedy justice is held to be a Fundamental Right under Article 21 of the Constitution of India in various judgments of Supreme Court is achieved. Sr. AAG Gagan Basotra accepted notice on behalf of State respondents and notice was also issued to Registrar General J&K High Court which was accepted by Adv Aditya Gupta. Meanwhile Division Bench directed Registrar Judicial shall file his response with regard to the availability of Translators from Urdu to English language.
