DB directs state to adopt some rational approach over shifting of dispensaries | PIL against shifting of Allopathic/ISM Center | | Jammu, Aug (JNF) : In a Public Interest Litigation (PIL) filed by residents of area of Chingus in the year 2002, have prayed that the Allopathic/ISM Centre, Chingus be not shifted to Khurk, Kalakote or any other place, the Division Bench (DB) of State High Court considered view that writ petition deserves to be disposed of with directions that State Government, before passing any order of shifting of Allopathic/ISM Dispensary in the whole State must adopt some rational approach. Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Adv RP Sharma appearing for the PIL and keeping in view that status-quo order passed on June 14, 2002 continuous, even today, Division Bench is of the opinion that writ petition deserves to be disposed of with directions that State Government, before passing any order of shifting of Allopathic/ISM Dispensary in the whole State must adopt some rational approach. The assessment shall be made on the basis of the total population of the area, accessibility to general public to the medical facilities, total number of persons visiting the Dispensary along with other factors like accessibility of roads etc, court observed. Till that time, shifting of dispensary shall remain stayed and disposed of PIL. |
