JMC delayed demolition of unsafe building, alleges owner

JAMMU, Aug 5: The owner of the building which collapsed on August 1 in Pacca Danga area of old city alleged today that delay on part of Jammu Municipal Corporation (JMC) resulted into the caving in of the old structure. Addressing a press conference here today, owner of the building Sunil Sawhney said that the structure collapsed due to the sheer negligence of JMC as we time and again approached the civic body to demolish the building as it was declared unsafe there by endangering the lives of the residents of the area as well as passers by. Sawhney said that we own a building consisting of one shop at the ground floor and a room at the 1st floor situated at Pacca Danga main Bazar near Maha Laxmi Temple. The tenant at the ground floor installed a huge Generator almost of the size of the shop 3 years back despite our utmost resistance. The vibrations of the Generator are so strong which weakened the whole structure day by day, he added. Jammu Municipal Corporation during their survey found the building in dilapidated condition about which Joint Commissioner (Admn.), JMC informed us vide his letter No. MJ/ESTT/1225 dated 11/05/2010. Further he asked us to demolished both the floors completely immediately as it is endangering the lives of passers by and it may collapse anytime. He further said that since the tenant at Ground floor did not remove Generator despite our several requests we could not demolish the building. Jammu Municipal Corporation again asked us to demolish the building immediately vide their letter No. MJ/Estt./CEO/208-09 dated 28. 06. 2010 otherwise Municipality will demolish the building for which we have to pay Demolishing Charges. We informed our inability to demolish the building as the tenant at ground floor was not removing the Generator vide our letter dated 07.07.2010. We requested Municipality to demolish the building for which we will pay Demolition Charges When Municipality did not take any action for one year, we again requested Municipality vide our letter dated 19.08.2011 to demolish the building at our cost Jammu Municipal Corporation prepared the estimate for Demolition of whole Building (Ground and 1st floor) and directed us to deposit an amount of Rs 21,000 as Demolition Charges vide their letter No. MJ/Estt./2402 dated 19.06.2012. We deposited the amount and informed the Municipality along with a copy of Cash Receipt No.14712 dated 22.06.2012 vide our letter dated 22.06.2012 and requested Municipality to demolish the building immediately in order to avoid the sudden collapse of the Building causing damage to life and property since rainy season was in the offing. When Municipality did not take any action for one month we again requested them vide our letter dated 23.07.2012 to demolish the building at the earliest as we had already deposited Demolition Charges. Due to the delay in execution of Demolition, a part of the Building suddenly collapsed instantly as the Generator was started on the morning of August 1.
