| 7 ½ yrs imprisonment for murderous assault | | | Jammu, Aug 6 (JNF) : City Judge Jammu Abdul Nasir awarded seven years and six months imprisonment to accused Dev Raj s/o Phumen Singh r/o Nagbani Tehsil & District Jammu who was facing trial for the last seven years for murderous attack one Bachan Lal and his wife.
According to the police case that on June 25, 2005 Bachan Lal in an injured condition along with his wife lodged a complaint that accused is having old enmity with the complainant over the portion of land at 8:00 when the complainant was in his house.
Accused came with a criminal intention having parthi I (sharp edge weapon) n his hand and trespassed in his house starting rebuking and when the complainant asked the accused not to rebuke, the accused attack him with parthi and caused injury over his arm and head and when the wife of the complainant Neelma came to the rescue of the complainant. Accused also attack on her and injured her also.
On raising who and cry by the complainant and his wife, some people came on spot, accused fled away from the Spot.
The police after completion of the investigation presented challan in the Court of law.City Judge Jammu Abdul Nasir after hearing Senior Prosecuting Officer Jatinder Anand for the state and accused with his counsel observed that the cross-examination has not shaken the confidence of prosecution witnesses.
It stands proved allegation against the accused and awarded three years imprisonment and fine Rs 5000 u/s 452 RPC and six months imprisonment and fine Rs 1000 for offence u/s 323 RPC, imprisonment of one year and fine Rs 2500 for offence u/s 324 RPC and imprisonment of three years and fine Rs 5000/- u/s 326 RPC and ordered that all the sentences shall run concurrently. |
