| Another sex scam involving lady constables unearthed | | HC directs SSP Crime Branch for investigation | | Srinagar, Feb 05 Justice Bashir Ahmed Kirmani of J&K High Court Srinagar Wing, today in a petition relating to another sex scam, directed SSP Crime Branch Srinagar to take cognizance of the incriminating statements and investigate the criminal aspects apparently percolating there from and furnish his report to CJM Srinagar, who shall the monitor the investigation, keeping this Court informed. The DGP of the J&K and authorities of IRCON and other concerned shall render all requisite aid and assistance to the Crime Branch for facilitating the investigation, the Court directed. This landmark order was passed in a writ petition filed by ASI Feroz Ahmed Nazar, who was demoted to the post of Head-Constable vide order dated August 21, 2006, under the grab of unlawful enquiry and without any reason feeling aggrieved and seeking quashment of said order and relegation of status back to the post of ASI. Justice Kirmani, after hearing counsel appearing for the petitioner and going through the petition, observed that it appears that on the basis of an anonymous complaint an enquiry was initiated against petitioner and the matter is not limited to the virus of impugned enquiry and its outcome only, but overflows its cantors to spell over the given limits to reveal an apparently frightening scenario concerning functioning of police department that acquires the texture of scandalous sexual exploitation of lady constables of the department and constitutes a subject of public importance. Enquiry initiated against him on the allegations that while posted as Incharge deployment of lady Constables at Srinagar he received bribe of Rs 2000/- each from certain lady-constable for keeping them off the daily deployment clandestinely. During enquiry, a charge-sheet was issued to him by Enquiry Officer on April 17, 2006 with four charges, the first, two and number four reflecting allegations of corruption and third allegation of his indulgence in immoral acts by sexually exploiting various lady constables. Prior to serving allegations to the delinquent officer, daily deployment statement of APCR Srinagar transpired that as many as 17 lady constables have never been deployed on any duty during most of the period under enquiry nor have been kept as reserve in PCR Srinagar. A lady constable namely Shahnaz Akhtar No 730/IR 3rd, in her statement stated that she is an eye-witness to the fact that ASI (M) Froze Ahmed was charging money as bribe from the interested lady constables for lapping them off from duty or giving them soft assignments. For letting off a lady constable, he was charging 1000/- per for one month Rs 700 for 15 days and Rs 500 for a week. She further stated that she is an eyewitness to almost all the omissions and commissions committed by the ASI Froze Ahmed. She further stated that he was supplying some girls to the officers of IRCON for sexual exploitation. One IRCON officer selected Shahnaz Akhter, the ASI Froze Ahmed compelled her to go with them but she managed her escape and saved her modesty. The lady constable revealed some alarming incidence in this regard in her statement and said the ASI (M) used residential quarter of constable Amar Pal Singh situated at Police Housing Colony Bemina, for sexually abusing a lady constable Nadra (name changed) for a couple of hours. The lady constable further stated that ASI had sold her to IRCON officers for sexual exploitation for Rs 6000 but she hardly saved her modesty and IRCON Officers were repeatedly calling her on Mobile Phone. In his statement constable Amar Pal Singh stated that Feroz Ahmed came to the government headquarter along with two girls and spent half an hour in privacy. Ultimately, the enquiry report found acceptance by Police Officers and petitioner was reduced in rank against which the petitioner has represented. Justice Kirmani in the 18 pages landmark order further observed that the enquiry report and statements record in original quoted only to avoid direct comment or expression of opinion on what is contained therein because it might be slightly premature but having been acted upon by respondent authorities. The enquiry report assumes enough substance to render it quite curious that even while faced with the ugly and undesirable situation revealed in the report that appears to be obscene that the senior brass of police department should have felt panicked at it, none of them showed their concern or a grasp of its ramifications, to act and stem the peeping rot somewhere, and initiate correctional, if not punitive measure. The fact that for recommending the punitive action as agreed by concerned authority ADGP, the Enquiry Officer had ignored the statements of senior officers like DIG and two SSPs, who choose to appear as witnesses. With these observations, the Court rejected the petition as being premature because of the pendency of petitioner’s review petition with competent authority, after disposal, he shall be at liberty to re-agitate the matter and directed the SSP Crime Branch for investigation. |
